DRA noted that the argument of Pacific Gas and Electric Company ("PG&E") that it would be exceeding its rate base forecast of investment for 2008 should not be accorded any weight, as PG&E had agreed to that capital investment forecast in a settlement with DRA of PG&E's 2008 General Rate Case, and thus PG&E had accepted the risk of any additional investment. SUMMARY: On November 20, 2007 Hayley Goodson, staff attorney for The Utility Reform Network (TURN) met with Robert Kinosian, advisor to Cmmr. Bohn in San Francisco. Also present were Stephen St. Marie, advisor to Cmmr. Bohn; and James Weil, Director for TURN. Weil stated that the November 6 proposed decision in this matter errs by unfairly excluding from consideration the financial model results of Aglet Consumer Alliance (Aglet), TURN and the Utility Consumers' Action Network (UCAN). Weil further stated that the Commission has directed A.07-05-003 et al. Aglet, TURN and UCAN parties to decide which modeling methods suit them and stick to those methods, and Aglet, TURN and UCAN complied with that direction. Weil noted that the three applicant utilities do not use the same screening criteria. Weil stated that the returns on equity in the proposed decision would likely be the highest authorized in the U.S. in 2007. On November 16, 2007 Brian Cherry, Vice President, Regulatory Relations for Pacific Gas & Electric Company (PG&E) met with Stephen St. Marie, advisor to Cmmr. Bohn in San Francisco. Written materials (attached to the notice) were used. Cherry stated that the proposed decision in the Cost of Capital proceeding failed to account for the increased risk PG&E faces in today's capital markets. Cherry argued for a higher ROE by noting that PG&E would be investing upwards of $15 billion of capital in utility infrastructure over the next 5 years and that it would exceed its rate base forecast of investment in 2008. Cherry stated that the risk to utilities regarding this level of incremental investment was large and that for every $100 million increase in rate base from authorized levels, PG&E would need a 10 basis point adjustment just to stay even with its ability to earn its authorized ROE.

SUMMARY: On October 15, 2007 Marcel Hawiger, staff attorney with The Utility Reform Network (TURN) orally addressed Cmmr. Bohn during his presentation at the 2007 CPUC Annual Meeting in Monterey, California. Hawiger stated that in TURN's opinion various regulatory mechanisms, such as revenue decoupling, ERRA balancing account treatment for fuel costs, the AB 57 framework for power purchase contracts, and recent applications for pre-approval of major capital expenditures (such as SONGS, Contra Costa 8 and AMI), have eliminated much of the traditional risk for California utilities. Hawiger stated that nevertheless California returns on equity are relatively high, and that all 2007 decisions in other states have adopted utility ROEs below 11.0%.
