Irlando noted that the issues in this case, as a result of this business decision, are: how are customers treated?; how are the policy goals of uninterrupted dial tone and affirmative choice by customers advanced?; who gets stuck with the cost of forced migration?; and is this going to be done in the right way? Verizon has opposed a hard date for customer transfer because it's not required under the rules and it would disincentivize Time Warner from doing everything in its power to ensure that its customers make an affirmative choice regarding their telephone carrier. TWCIS representatives discussed the fact that this process, which is contemplated in the Mass Migration Guidelines to take 90 days has to date taken well over 100 days and that TWCIS needs to have a Commission decision before February 28, 2008 in order to make sure that all customers are addressed prior to that date. TWCIS representatives also discussed the various ways that the parties and the Commission could address the customers that do not respond to TWCIS notices to change carriers.
