Urick explained that the Commission has already found that the plant is needed. Urick also explained that approval of the FIN 46 effects here would be non-precedential. Schneider described the economics that support the revised Power Purchase Agreement, including the put and call options prices and why these prices are advantageous.

With regard to SO1 offers, parties noted that Pacific Gas and Electric Company had incorporated conditions in its terms and conditions that were not consistent with SO1 contracts. Parties explained that these objectionable terms related to features seeking retroactive adjustment of payments for delivered energy and capacity. With regard to Mid-Set, parties noted that the long term firm power resource cogeneration project was in a unique position of terminating before the establishment of a policy or long run avoided cost determinations. Parties also reviewed options for needed relief related to this long term firm resource timing regarding the establishment of a firm, long term contract in light of the operating conditions associated with Mid-Set.

CCC noted that in the petition Edison seeks to set aside and vacate the Commission's decisions requiring Edison to sign SO1 contract extensions with existing qualifying facilities. CCC representatives asked for the Commission's assistance in defending the decisions. The CCC representatives also explained how important it is for California's manufacturing and industrial companies to be able to continue operating their existing cogeneration facilities.

Joseph also noted that the projects will reduce the consumption of natural gas because they are much more fuel-efficient than older plants. Joseph noted that the other projects each have problems: Enpex will have trouble getting emissions offsets, the capability of the Nevada Hydro developers is questionable, new transmission is hard to site, and Mexican plants mean exporting jobs and importing pollution.

Leslie stated that it is troubling that the Project was accepted when it is 'electrically' outside SDG&E's local reliability area, and when the Project cannot serve SDG&E's local reliability needs until after the end of the RFP period. Leslie explained that the economic benefits of the Project can only be assessed by considering, among all other costs, the cost of the associated transmission facilities. Leslie emphasized that Coral does not necessarily oppose the Project; however the Commission's approval of the Project should not be allowed to delay or otherwise prejudice the Commission's review of new, 500 kV transmission line projects that are being considered in the ISO's STEP process in that have the potential to increase SDG&E's import capability.

Engelbrecht stated that SER had just brought over 2350 megawatts of high-efficiency generation into the southwestern market and that precluding their participation in a future competitive solicitation conducted by affiliate San Diego Gas & Electric Company (SDG&E) would reduce the liquidity in the SDG&E market to the detriment of ratepayers. Kelly-Cochrane stated that the recently issued decision was unclear as to whether the affiliate ban covered gas-related and potentially LNG-related transactions and noted that this could affect the utilities' access to the benefits of LNG supplies. SER representatives concluded by indicating that Sempra companies would be seeking to reverse or stay the ban pending a full evidentiary exploration of the implications and adverse consequences of the affiliate ban as part of a duly convened evidentiary hearing.

With respect to requirements to purchase capacity on a forward basis, Bogy explained PG&E's opposition to the ISO's 90 percent year-ahead and 100 percent month-ahead requirements adopted in Cmmr. Peevey's alternate. Finally, Bogy stated that PG&E recommends modifying the proposed and alternate decisions to recognize the importance of debt equivalence. Bogy also reiterated PG&E's strong support for revising the SRAC methodology because it produces prices that exceed avoided cost.

AREM representatives stated that AREM members do not oppose energy service providers (ESPs) being required to demonstrate resource adequacy, but would oppose being required to make that demonstration to the Commission. AREM representatives observed that the alternate of Cmmr. Peevey is consistent with AREM's position that any resource adequacy requirement for ESPs and other non-utility load-serving entities (LSEs) should be administered by the California Independent System Operator. AREM urged the Commission, however, to clarify in its final decision that consistent standards should be used to determine whether a power purchase agreement counts toward a LSE's reserve requirement, irrespective of whether the contracting party is the Department of Water Resources (DWR) or a utility, and ESP or other LSE. AREM also urged the Commission to clarify that for purposes of determining resource adequacy, the capacity associated with DWR contracts should be allocated to ESPs to the extent their customers pay for the cots of those contracts through Direct Access Cost Responsibility Surcharges.

Kuga and Manheim stated PG&E's concern with opt-out provisions for direct access and community aggregation suppliers. Kuga and Manheim indicated that non-utility suppliers should be held to the same planning reserve requirements imposed on utilities. Kuga and Manheim stated that with respect to the alternate, the Commission should condition any additional direct access on the ISO's implementation of effective resource adequacy requirements.

ISO also expressed concern about the time frame for getting resource adequacy requirements in place. Parties also discussed the Miguel-Mission transmission line. Winter expressed urgency in getting the line sited.
