Milner explained, however, that the AD¿s proposed 1385 maximum Wobbe Index is acceptable to Shell Trading. Dr. Kuipers explained that the PD's concerns regarding the performance of consumer appliances and gas turbines with higher Wobbe Index gas are not valid. Leslie explained that the California Environmental Quality Act does not apply to the Commission¿s decision on gas quality. Leslie urged the Commission to deny August 29th motion for oral argument. Miler asked the Commission to make one change to the AD.

Clare stated that the DD's plan of including twenty-five percent of hedges for Winter 2006/2007 within CPIM was not appropriate. Clare also pointed out that fundamentally hedging and CPIM serve different purposes. Clare reiterated that when treated separately these programs complement each other but when combined there is a conflict. Dietz noted that the challenge to developing a hedge strategy and plan is arriving at sound assumptions on the risk preferences of customers. Pestana and Clare stated that PG&E's winter peak and storage situation might mean that PG&E customers have more interest, compared to other California gas customers, in insurance against price spikes.

Clare also pointed out that fundamentally hedging and CPIM serve different purposes. Dietz noted that in most years, this price insurance will not pay out, but taken over the long run, it will be a wise investment.

Cushnie stated that the Commission should adopt SCE's proposal to implement an interim gas quality standard that is consistent with the quality of natural gas historically delivered to end-use customers of Southern California Gas Company (SoCalGas) and San Diego Gas & Electric Company (SDG&E). Cushnie urged the Commission to require a definitive study to determine whether it is more cost effective to require LNG facilities to deliver gas supplies to the SoCalGas/SDG&E system that is consistent with the historical heat content of natural gas deliveries to end-use customers or to require end-use customers to be responsible for making any necessary modifications to their gas-burning equipment to accept higher heat content gas. Dr. Liu explained that higher heat content gas from LNG deliveries should not be allowed and that instead, the Commission should require SoCalGas and SDG&E to accept natural gas supplies with a heat content that is more reflective of historical gas deliveries to end-use customers in southern California.

Graham argued that an appropriate reserve margin of capacity allows the market flexibility to move purchases between receipt points, creating more gas-on-gas competition. In conclusion, Graham stated that northern California has sufficient backbone transmission and storage infrastructure, as compared to the proposed backbone capacity guideline, through 2016. Halverson stated that a full and timely recovery of investments in backbone capacity is necessary.

Zafar reiterated SoCalGas/SDG&E's need to have a decision on Phase I by June 2004 in order to gain Commission authorization to allow adequate time for the relevant interstate capacity negotiations. Zafar also described the benefits of rolled-in ratemaking for expanded facilities, and SoCalGas/SDG&E's desire to have the Commission issue a decision in Phase 1 that provides overarching policy guidelines dealing with supply access, integration of the SDG&E and SoCalGas transmission systems, and firm access rights.
