Cragg outlined the current treatment of debt equivalence in the evaluation of bids in competitive solicitations for electric generating resources. Meal described debt equivalence associated with utilities' purchases under power purchase agreements ("PPAs") and how its impact was evaluated by the credit rating agencies. Meal explained that debt equivalence was not a direct cost and that it has no impact on the balance sheets of the purchasing utilities. Meal then described what happens with regard to debt equivalence when a California utility enters into a PPA. Cragg stated that consideration of debt equivalence in the evaluation of bids in competitive solicitations tilted the evaluation in favor of utility-owned projects and projects with lower capacity costs and shorter contract terms, even though the Commission's policy on renewable power and greenhouse gas reduction might encourage projects with relatively high capacity costs. Meal stated that focusing only on one possible risk in bid evaluation while ignoring the risks that PPAs enable the utility to avoid skewed the evaluation. Meal further explained how any debt equivalence impacts on credit quality are accounted for in cost of capital proceedings where all of a utility's risks can be evaluated and where utilities can be compensated for any adverse impacts of debt equivalence. Mara explained further that the PD's interpretation of Public Utilities Code Section 380 is incorrect. Mara also noted that if the Commission feels compelled to take action, the PD has some welcome provisions.

Jacobson stated that ALJ Brown's proposed decision (PD) regarding cost allocation for new generation resources is an important step towards ensuring the development of new generation resources in California. Jacobson explained that while PG&E strongly supports the PD, it should be modified in three respects: first, to clearly indicate that the cost allocation mechanism is durable; second, PD should be clarified to ensure that utilities have a choice on whether or not to recover new generation costs through the adopted cost allocation mechanism or through the non-bypassable charge. Jacobson indicated that choice was important to PG&E. Jacobson explained that, third, the PD should apply to all new generation resources.

Joseph stated that in at least two prior decisions, the Commission had decided to have both utility owned and independent generation. Joseph noted that the draft decision foreclosed utility owned generation by requiring Pacific Gas and Electric Company and Southern California Edison Company to fill up all of the system need with power purchase agreements. Joseph asserted that this would result in higher costs because the independent generators would know that they had no competition from cost based generation, would force bundled customers to pay more than their fair share for any utility owned generation, and would deprive direct access customers of the best deal. Joseph noted that utility owned generation may be the best deal for customers, with Colusa being an example.

Wan stated that the discussion in the proposed decision (PD) should be modified so that it does not prejudge the auction design or nature of the `energy rights' to be auctioned. Wan asserted that it was important that the utilities not be required to accept bids if the bid prices and terms were not competitive or above an established reservation price. Wan urged the Commission to clarify that the investor-owned utilities (IOUs) have an opportunity to choose between the cost allocation methodology in the PD and the 10-year non-bypassable charge mechanism adopted in D04-12-048. Wan stressed that a critical aspect of the PD was the ability of the IOUs to manage the energy of new resources under the terms of the Joint Parties' proposal in the event that an energy auction is not successful.

Foster explained the benefit and cost allocation mechanism advanced by Edison, PG&E, NRG Energy, AES Corporation, and The Utility Reform Network in this proceeding. Foster explained that all customers who benefited from the generation to be acquired under the proposal should be allocated the benefits and costs of such generation, that the mechanism was only intended to be applicable to the procurement of resources until a capacity market was established in California, and that Edison believed the area known as SP-15 would need between about 500 MW of generation in 2008 and 1,900 MW of new generation in 2011.
