Cherry mentioned, however, the final, measured savings come in at less than 85% which is still above the Commission's threshold for penalties at 65% of the Commission's goals. Dietz explained that if the joint utilities' Petition for Modification of Decision 07-09-043 is granted, the total net benefits of the energy efficiency program portfolio would be shared with the IOUs using a percentage--zero, nine, or twelve percent based on the actual installation of energy efficiency measures and practices and estimates of energy savings, based on the best available information, for the initial interim claims. Dietz stated that if the petition for modification is granted, adjustments in the final true-up would not affect that interim incentive payments, but only the final true-up payment. The only exception is if the final ex post results were to drop the utility's performance below sixty five percent of the Commission's energy-saving goals, in which case penalties and forfeiture of interim payments could result.
