Dietz stated that if the petition for modification is granted, adjustments in the final true-up would not affect that interim incentive payments, but only the final true-up payment. The only exception is if the final ex post results were to drop the utility's performance below sixty five percent of the Commission's energy-saving goals, in which case penalties and forfeiture of interim payments could result.

As discussed in Section 1 of today's ruling, Opening Comments in response to the correction submitted by The Utility Reform Network (TURN) are due by March 5, 2007.
