utilities' Petition for Modification of Decision 07-09-043 is granted, the
total net benefits of the energy efficiency program portfolio would be shared
with the IOUs using a percentage--zero, nine, or twelve percent based on the
actual installation of energy efficiency measures and practices and estimates
of energy savings, based on the best available information, for the initial
interim claims. Dietz stated that if the petition for modification is granted,
adjustments in the final true-up would not affect that interim incentive
payments, but only the final true-up payment. The only exception is if the
final ex post results were to drop the utility's performance below sixty five
percent of the Commission's energy-saving goals, in which case penalties and
forfeiture of interim payments could result.

1.
Pacific Gas and Electric Company, Southern California Edison Company, San Diego
Gas & Electric Company, and Southern California Gas Company (collectively, "the
utilities") shall submit the additional calculations and clarifying information
described in Section 2 of today's ruling by March 8, 2007. Interested parties
may submit comments on these submittals by March 16, 2007.
2. As discussed in
Section 1 of today's ruling, Opening Comments in response to the correction
submitted by The Utility Reform Network (TURN) are due by March 5, 2007. That
correction is posted on the Commission's website at:
http://www.cpuc.ca.gov/static/energy/electric/energy+efficiency/rulemaking/.
Reply Comments are due by March 16, 2007.
3. As discussed in Section 3 of
today's ruling, the utilities, TURN, Natural Resources Defense Council, the
Division of Ratepayer Advocates and Community Environmental Council shall
provide their final proposed listing of the programs and costs included in
their shared-savings proposals and reflected
in Joint Summary Tables 8A and
8B. These listings shall be submitted no later than March 5, 2007.
4. All
parties filing comments shall adhere to the directions in this ruling regarding
the scope of those comments and the format requirements for electronic
spreadsheets.
5. The format requirements for electronic spreadsheets described
in Section 5 will apply to all electronic spreadsheets submitted by all parties
and agency staff in this rulemaking.
6. All comments and submittals required
by this ruling shall be filed at the Commission's Docket Office and served on
the service list in this proceeding pursuant to the Electronic Service
Protocols attached to the Order Instituting Rulemaking and consistent with
Rules 1.9 and 1.10 of the Commission's Rules of Practice and Procedure. Hard
