NOTICE OF AVAILABILITY

OF DRAFT RESOLUTION T-17249

Draft resolution T-17249 will be on the agenda of the Commission's February 4, 2010 meeting. If adopted, draft resolution T-17249 will (1) modify the charter of the Telecommunications Access for the Deaf and Disabled Administrative Committee (TADDAC), the primary advisory board to the Deaf and Disabled Telecommunications Program (DDTP); and (2) eliminate the charter of the California Relay Service Advisory Committee (CRSAC), pursuant to Resolution T-17212 (August 20, 2009). The draft resolution implements Commission directives regarding the merger of the CRSAC into the TADDAC. It also makes additional revisions to update the TADDAC charter to reflect the current realities of the TADDAC's duties and operation, including, among other things, eliminating utility and vendor liaisons to the TADDAC, changing the expenses and the per diems for officers, clarifying the TADDAC's duties and responsibilities, and changing the number of officers.

The above draft resolution is available at the Commission's web-site at www.cpuc.ca.gov by searching for "T-17249" in the search box in the upper right hand corner or accessing the "Items Open for Public Comment" section of the Commission's web-site by clicking on "Online Documents" and then "Items Open for Public Comment" under "Search By Document Type."

On February 4, 2010, the Commission may vote on this resolution, or it may postpone a vote until later.  When the Commission votes on a draft resolution, it may adopt all or part of it as written, amend, or modify it, or set it aside and prepare a different resolution.  Only when the Commission acts does a resolution become binding on the parties. The conformed resolution, when adopted by the Commission, is available at the same website.  

Pursuant to California Public Utilities (P.U.) Code section 311(g), the draft resolution is available for public comment.  Comments must be submitted no later than 5:00 p.m. on January 25, 2010.  Comments should focus on factual, legal, and/or technical errors in the draft resolution.  Comments shall include a subject index listing the recommendations to the draft resolution, a table of authorities, and an appendix setting forth the proposed revised findings and ordering paragraphs. If the comments exceed five pages in length, they shall also include an Executive Summary.

Reply comments must be submitted no later than 5:00 p.m. on January 29, 2010 and shall be limited to identifying misrepresentations of law, fact, or condition of the record contained in the comments of other parties. If the reply comments exceed five pages in length, they shall include an Executive Summary.

The date of submission is the date the comments or reply comments are received by the Communications Division. Late-filed opening comments and/or reply comments will ordinarily be rejected.  However, in extraordinary circumstances, a request for leave to submit comments or replies late may be filed together with proposed comments/replies.  An accompanying declaration under penalty of perjury shall be submitted setting forth all the reasons for the late submission.
