R E S O L U T I O N
Resolution T-16890. Revocation of 41 Authorities Issued to Competitive Carriers for Failure to Comply with Commission Decisions.

This resolution revokes competitive carrier authorities held by the companies listed in the Discussion Section for failure to comply with Decisions 93-05-010, Ordering Paragraph 4 and 95-12-056 and the wireless registration process.
Decisions 93-05-010 Ordering Paragraph 4 and 95-12-056 and the wireless registration process state that the Commission will consider the revocation of competitive carriers that are more than 90 days late in filing annual reports and remitting surcharges.
The following steps were taken to locate the companies and determine their status:
1. Telecom Division (TD) determined that the carriers are at least 90 days late in filing annual financial reports with the Commission.
2. TD attempted to contact all the carriers on this list. Correspondence sent to the last known addresses of every carrier on this list was either returned to TD staff by the post office or unanswered.
3. Since TD's license application process requires a certificate from the Secretary of State stating that a carrier has an active authority, TD checked the Secretary of State website for the status of the authority to operate a business in California. None of these companies are considered active by the Secretary of State and could not operate a business in California unless the status of authority were changed to active.
4. Notice of company names was placed in the Commission Calendar for 30 days. Interested parties were invited to call TD staff with questions or comments on these carriers' locations, but TD was not contacted by these companies.
Discussion
This resolution lists authorities granted to various firms. In several cases, a single firm possesses more that one authority to operate in California. The authorities revoked by this resolution are the following:

These companies may owe additional surcharges. Therefore, the Legal Division may, if it chooses, pursue the companies for any owned surcharges.
Telecommunications Division's draft resolution in this matter was noticed in the Commission's Daily Calendar beginning on October 5, 2004, in accordance with PU Code Section 311(g)(1). The following comments were received: ___________________
1. The companies on the above list were certificated or registered by the Commission as telephone carriers.
2. Proper measures were taken by Telecom Division staff to locate these companies. Each company had failed to respond to TD's communications. It is, therefore, reasonable to assume that these companies are no longer providing public utility service.
3. The companies have not timely filed annual financial reports for at least the past year.
4. These companies may owe additional surcharges. The Legal Division may pursue the companies, if it chooses, for any owned surcharges.
5. The companies' authorities should be revoked and their Utility Identification Numbers should be cancelled for failure to comply with D.93-05-010 Ordering Paragraph 4, D.95-12-056, and the wireless registration process.
THEREFORE, IT IS ORDERED that:
