Findings of Fact

1. The scoping memo for this proceeding was issued on May 24, 2006.

2. The deadline for resolving this proceeding in the scoping memo was December 31, 2008.

3. The December 31, 2008 deadline from the scoping memo was extended in D.09-01-027 to March 1, 2009, in D.09-02-020 to April 30, 2009, in D.09-04-026 to June 29, 2009, in D.09-06-040 to August 28, 2009, in D.09-08-019 to October 27, 2009, and in D.09-10-050 to December 26, 2009.

4. R.09-11-014 was opened on November 20, 2009 to consider going-forward energy efficiency issues.

5. Due to the continuing need for review of a Motion and a Petition for Modification filed by PG&E in July 2009, there is a need for this rulemaking to remain open.

Conclusions of Law

1. The statutory deadline imposed by Pub. Util. Code § 1701.5(a) and (b) should be extended for 60 days.

2. In accordance with Rule 14.6(c)(4), the comment period is waived.

IT IS ORDERED that the statutory deadline for resolving this proceeding is extended to February 24, 2010.

This order is effective today.
