8. Request for Treatment as a Non-dominant Carrier

Pacific Lightwave requests treatment as a non-dominant carrier, which would include exemption from the requirements of Pub. Util. Code §§ 816-830 concerning stocks and security and § 851 concerning the encumbrance and transfer of utility property. The Commission detailed its rules regarding exemption of non-dominant carriers in D.85-01-008, and subsequently modified in D.85-07-081 and D.85-11-044. We grant Pacific Lightwave's request for non-dominant carrier status, provided that they follow all rules detailed in the above-referenced decisions.
