In R.02-01-011, pursuant to Pub. Util. Code § 366.2(d),5 the Commission adopted a Cost Responsibility Surcharge (CRS) applicable to MDL to ensure there is no cost shifting among customers.6 The Commission subsequently adopted Resolution Res. E-4064, approving, with modifications, PG&E's tariff Schedule E-NMDL, implementing prior Commission directives and authorizing procedures for the billing and collection of the CRS and other NBCs from the NMDL Customers located within PG&E's service area.
Schedule E-NMDL identifies the NBCs that NMDL Customers are billed, the exemptions from and exceptions to NBCs, and the definitions and procedures establishing PG&E's obligations for billing and collecting NBCs from NMDL Customers. Pursuant to Res. E-4064, Schedule E-NMDL also permits bilateral agreements between PG&E and POUs or POU customers as an alternative to PG&E Schedule E-NMDL.7
The NBCs applicable to NMDL customers within the service territory of PG&E served by the Districts include the DWR Bond Charge, the ongoing Competition Transition Charge (Tail CTC)8 (which are components of the CRS), the Trust Transfer Amount (TTA) Charge, and the Nuclear Decommissioning (ND) Charge. There are other charges in the NMDL tariff that are not applicable to the NMDL customers served by the Districts (e.g. the DWR Power Charge).9
