Discussion

Transferor holds a PSC certificate authorizing the transportation of passengers and their baggage on an on-call basis between points in Alameda, Contra Costa, San Francisco, Santa Clara, and Solano Counties, on the one hand, and San Francisco (SFO), Oakland (OAK), and San Jose (SJC) International Airports, on the other hand. The certificate was granted by Decision (D.) 06-04-051. The application requests approval to transfer certificate PSC-18461 to Transferee.

The proposed transaction is described in the Purchase and Sale Agreement attached to the application as Exhibit A. Transferee has agreed to purchase the certificate, trade name, and a 2008 Chevrolet van for $7,600. Transferee indicates he has the knowledge and ability to assume the operation of Transferor's PSC business. He has been employed as a shuttle driver for over four years. Transferee reports he will operate initially with the one 7-passenger van that he is purchasing from Transferor, and will add other equipment as needed to meet the public's service needs. His financial statement as of March 15, 2011, discloses assets of $407,000, liabilities of $750, and net worth of $406,250.

Notice of filing of the application appeared in the Commission's Daily Calendar on April 1, 2011.

In Resolution ALJ 176-3272 dated April 14, 2011, the Commission preliminarily categorized this application as ratesetting, and preliminarily determined that hearings were not necessary. No protest has been received. Given this status, public hearing is not necessary, and it is not necessary to alter the preliminary determinations made in Resolution ALJ 176-3272.

This is an uncontested matter in which the decision grants the relief requested. Accordingly, pursuant to Pub. Util. Code § 311(g)(2), the otherwise applicable 30-day period for public review and comment is being waived.
