3. Burden of Proof
Under Pub. Util. Code Section 1702, a complainant must prove an alleged violation of a specific standard contained in a statute, rule, or order of the Commission, or a tariff which has been approved by the Commission. The standard of proof has been well settled and is by a preponderance of the evidence.2
