5. Preliminary Determination of Need for Hearing

We must also preliminarily determine the need for hearing. (Rule 7.1(d).) Although we expect that many of the issues may be resolved through the formal filing of comments and replies, we preliminarily determine that hearing will be needed, at least on some issues.
