ORDER EXTENDING STATUTORY DEADLINE

Summary

Pub. Util. Code § 1701.2(d) provides that adjudication cases shall be resolved within 12 months of initiation unless the Commission makes findings why that deadline cannot be met and issues an order extending that deadline. In this proceeding, the 12-month deadline is March 24, 2009.

A final decision in this complaint case is not expected until late 2009.

There have been numerous continuances at the request of the parties to explore the possibility of settlement. Settlement discussions proved fruitless and a hearing is necessary. Hearing has been set for February 10, 2009. To hold a hearing, review the record, and prepare a decision will take us into late 2009. Because of the foregoing reasons, a six-month extension order is required.
