RESOLUTION

RESOLUTION ST-112. GRANTING APPROVAL OF THE SAN FRANCISCO BAY AREA RAPID TRANSIT DISTRICT'S SAFETY CERTIFICATION PLAN FOR THE EAST CONTRA COSTA COUNTY TRANSIT TRANSFER PLATFORM AND GUIDEWAY PROJECT __________________________________________________________

SUMMARY

This Resolution grants San Francisco Bay Area Rapid Transit District's (BART) request for approval of its "Safety Certification Plan (SCP) for the East Contra Costa County Transit Project (eBART) Transfer Platform and Guideway Project (eBART TPG), Revision 0, dated February 4, 2010."

BACKGROUND

Commission General Order 164-D, Rules and Regulations Governing State Safety Oversight of Rail Fixed Guideway Systems, requires Rail Fixed Guideway Systems to prepare a project-specific SCP for each major project and ensure that all entities involved in design, construction, operation, and maintenance of the project shall comply with its requirements. The SCP ensures that elements critical to system safety are planned, designed, constructed, analyzed, tested, inspected, and implemented. The SCP also ensures that training is provided and rules and procedures are followed.

BART submitted its "Safety Certification Plan (SCP) for the East Contra Costa County Transit Project (eBART) Transfer Platform and Guideway Project (eBART TPG), Revision 0, dated February 4, 2010" to Commission staff (staff) for review and requested Commission approval on March 22, 2010. The entire eBART system will extend rail transit eastward from the existing Pittsburg Bay Point Station to a terminus station in Antioch.

This proposed project will include trackwork modifications to the existing Pittsburg Bay Point Station, extending the track 3,000 feet east of the existing platform. There will be construction modifications to the existing median access tunnel at the east end of the station. The ancillary building on the north side of the Department of Transportation's (Caltrans) right-of-way will also be modified. BART will also prepare for a guideway extension from the Pittsburg Bay Point Station to the Loveridge Interchange which will include demolition, grading, drainage, sub-ballast, and concrete barriers, and utility conduit installations.

DISCUSSION

The SCP is filed as required by General Order 164-D. Staff assisted BART to ensure the SCP is comprehensive. Staff reviewed the SCP and found it to be in accordance with General Order 164-D.

BART shall submit to staff a written Safety Certification Verification Report (SCVR), as required by General Order 164-D, at least 21 calendar days prior to start of service. Staff shall respond to the SCVR within nine (9) calendar days of filing by indicating that it approves the SCVR, or identifying areas that are not acceptable to staff. Staff shall give its approval of the SCVR by issuing a formal letter to BART.

NOTICE

On June 16, 2010, BART's request for approval of the SCP was published on the Commission's Daily Calendar.

COMMENTS

The draft resolution of the Consumer Protection and Safety Division in this matter was mailed in accordance with Section 311 of the Public Utilities Code and Rule 14.2(c) of the Commission's Rules of Practice and Procedure. No comments were received.

FINDINGS

1. BART submitted its "Safety and Security Certification Plan for the East Contra Costa County Transit Project (eBART) Transfer Platform and Guideway Project" to staff for review and Commission approval on March 22, 2010.

2. This proposed project will include trackwork modifications to the existing Pittsburg Bay Point Station, extending the track 3,000 feet east of the existing platform. THEREFORE, IT IS ORDERED THAT:

1. The San Francisco Bay Area Rapid Transit District's request for approval of its "Safety Certification Plan (SCP) for the East Contra Costa County Transit Project (eBART) Transfer Platform and Guideway Project (eBART TPG), Revision 0, dated February 4, 2010" is granted.

2. The San Francisco Bay Area Rapid Transit District shall submit the Safety Certification Verification Report to Commission staff as required by Commission General Order 164-D, at least 21 calendar days prior to start of service.

3. Staff shall respond to the Safety Certification Verification Report within 9 calendar days of filing by indicating that it approves the Safety Certification Verification Report, or identifying areas that are not acceptable to staff. Staff shall give its approval of the Safety Certification Verification Report by issuing a formal letter to the San Francisco Bay Area Rapid Transit District.

4. This Resolution is effective today.
