Resolution T-17324. Request for Reinstatement of Certificate of Public Convenience and Necessity Held by Freedom Telecommunications, Inc. (U-7110-C).

This Executive Director Resolution reinstates the Certificate of Public Convenience and Necessity (CPCN) held by Freedom Telecommunications, Inc. (U-7110-C).
Freedom Telecommunications, Inc., was originally licensed to provide competitive local exchange service by D.08-08-016 (A.08-05-009). According to our records, the company did not file the User Fee report in a timely manner ignoring Commission notices, consequently Resolution T-17300, adopted December 16, 2010, revoked operating authority to several carriers including Freedom for failure to submit User Fee. On December 30, 2010, after its authority to operate has been revoked, Freedom submitted its User Fee report.
Discussion
The Communications Division recommends that the CPCN be reinstated. Despite its user report's not being sent to the Commission in a timely manner, Freedom reported zero intrastate revenue. Since Freedom has now complied with Commission reporting requirements, the carrier should be reinstated.
Findings
1. Freedom Telecommunications, Inc., was granted a Certificate of Public Convenience and Necessity to provide competitive local exchange services in D.08-08-016, dated August 22, 2008.
2. Resolution T-17300 revoked Freedom Telecommunications, Inc.'s operating authority for failure to submit the User Fee report in a timely manner.
3. The company submitted its User Fee report after Resolution T-17300 became effective.
4. Since Freedom Telecommunications, Inc. has now complied with Commission reporting requirements for its User Fee, the Certificate of Public Convenience and Necessity should be reinstated.
THEREFORE, IT IS ORDERED that:
1. Freedom Telecommunications, Inc.'s Certificate of Public Convenience and Necessity is reinstated.
2. Utility Identification Number U-7110-C is reissued to the company.
3. Freedom Telecommunications, Inc., is directed to be more timely in following its regulatory deadlines to avoid revocation and penalty actions.
This Resolution is effective today.
