CPUC INVESTIGATIONS RESULT IN ENFORCEMENT ACTIONS
AND FINES IMPOSED ON VARIOUS LIMOUSINES,
SHUTTLES, AND BUS COMPANIES
SAN FRANCISCO, January 28, 2009 - The California Public Utilities Commission (CPUC), in its ongoing commitment to consumer protection, has taken a number of actions to protect consumers from illegally operating passenger carriers.
During the fourth quarter of 2008, CPUC took the following enforcement actions against limousine, bus, and shuttle companies for violations of the Public Utilities Code and CPUC rules and regulations, including General Order (G.O.) 157-D.
Administrative Citation
Nineteen (19) companies were cited and fined (totaling $22,750) for violations ranging from:
1. Advertised beyond the scope of its authority
2. Engaged employees without procuring evidence of workers' compensation insurance
3. Engaged unlicensed sub carriers in violation of G.O. 157-D
4. Failed to comply with G.O. 157 rules (equipment list, waybills, out of class drivers, vehicle not properly SPAB certified, fictitious business name, display of TCP # on vehicles)
5. Failed to enroll drivers in a mandatory Drug and Alcohol program
6. Failed to enroll drivers in DMV Pull Notice program
7. Failed to maintain business records
8. Failed to pay PUCTRA fees or under-reported gross revenue
9. Failed to respond and provide business records upon request in a timely manner
10. Operated with no evidence of public liability insurance in effect and on file
11. Operated without a valid authority (suspension, revocation, expiration, outside of the scope of its authority or unlicensed)

In its ongoing efforts to clamp down on unlicensed passenger carriers, the CPUC had telephone service shut off to a limousine company operating in California without a charter-party permit. Public Utilities Code Section 5371.6 provides that any person aggrieved by this action may file a complaint with the CPUC and request a hearing.
1. Vincent Robert Gutierrez dba For Big Things Limousines, For Big Things Limousines LLC, and For Big Things Limo, Elk Grove (TCP 14266-P Expired) Defendant advertises his unlawful limousine business on the Internet at three websites and through distribution of business cards. Defendant stated that he stopped all operations in California, and is only doing operations in Nevada, even though defendant did not hold authority to operate as a charter limousine in Nevada. Notwithstanding CPUC staff Cease and Desist letters directing defendant to immediately cease all unlawful advertisements in California, defendant continues to violate the law as evidenced by CPUC staff sting call. On December 16, 2008, CPUC staff obtained an order "Finding of Probable Cause" signed by Sacramento County Superior Court Judge Gary Ransom. The order finds that telephone service at six numbers was being used to violate criminal laws in the State of California. Defendant has a pending application for a permit.

Eighteen companies were issued Official Notice for one or more of these violations:
1. Advertising prior to issuance of authority
2. Engaged workers without evidence of workers' compensation insurance
3. Engaged unlicensed sub-carriers
4. Failed to enroll drivers in the DMV Employee Pull Notice program
5. Failed to update equipment list
6. Failing to remove revoked number TCP numbers
7. Operated and advertised without a valid permit (prior to issuance, expired, unlicensed)
8. Soliciting clients, no pre-arrangement
9. TCP number not displayed on advertisements, vehicles and waybills
10. Waybill violations
