ASSIGNED COMMISSIONER'S AND ADMINISTRATIVE LAW JUDGE'S RULING SETTING PROCEDURAL SCHEDULE FOR EVALUATING
PETITION TO MODIFY DECISION 08-04-058
On August 15, 2008, Assemblyman Martin Garrick and the Chambers of Commerce of Carlsbad, Encinitas, Escondido, San Marcos, Oceanside and Vista filed their Petition for Modification of Decision (D.) 08-04-058. The petition contends that the Commission's decision was the result of erroneous interpretation of public comment received and the absence of comment from significant portions of the affected public. Due to a claim of inequitable economic harm imposed on northern San Diego County businesses and residences, the petition asks the Commission to modify the decision to adopt an area code overlay, rather than the area code split that had been adopted.
As set forth below, the Commission will take additional public comment to evaluate this petition and will modify filing requirements to allow the written record to be completed by September 5, 2008.

Due to the relatively short notice of these public participation hearings, the Commission's Public Advisor shall direct the carriers to implement such means of customer notification that are efficient and effective in reaching the largest numbers of customers. Electronic and internet-based notification should be encouraged. The Public Advisor may also take such direct actions as are necessary to notify interested groups of customers.
A complete copy of this ruling shall be served on all parties to the service list and the cities, counties, and Chambers of Commerce in the 760 area code.

This schedule will enable a proposed decision to be prepared and mailed on September 16, 2008, for consideration by the Commission at its October 16, 2008, meeting. This schedule will allow resolution of the petition prior to the currently-scheduled November 8, 2008, implementation of permissive dialing, which will give the Commission the full range of options for their consideration on October 16, 2008. For this reason, the filing of Responses and Replies to Petitioners' Motions for Stay and to Shorten Time shall be suspended, pending further ruling or order of the Commission.
Implementation of Permissive Dialing
Carriers should continue network preparations necessary for implementing permissive dialing on November 8, 2008. However, pursuant to Ordering Paragraph Six of D.08-04-058 and in consultation with the Director of the Communications Division, carriers are directed not to mail customer notices of the initiation of permissive dialing, pending further ruling or order of the Commission.
