4. Category of Proceeding

Rule 6(c)(2) of our Rules of Practice and Procedure provides that the order instituting rulemaking "shall preliminarily determine the category" of the proceeding. We believe the issues in this proceeding should be categorized as "ratesetting," as that term is defined in Rule 5(c). We preliminarily determine that ratesetting is the most suitable category for this subject matter, since the incentive payments that result from the RRIM will have an impact on utility rates.
