10. Comments On Proposed Decision

The proposed decision of the ALJ in this matter was mailed to the parties in accordance with Pub. Util. Code § 311(d)(1) and Rule 77.1 of the Rules of Practice and Procedure.

Wild Goose filed initial comments, early, on July 3, 2002. On July 8, the following parties filed initial comments: ORA; Lodi; PG&E; and Roseville Land, which also filed a reply to Wild Goose's comments as part of its comments on the alternate decision of Commissioner Peevey. TURN did not file comments on the proposed decision; however it's July 9 comments on the alternate decision concern text common to both drafts. On July 15, the following parties filed reply comments: Wild Goose, Lodi, PG&E, and TURN.

After review and consideration of all comments, we have revised the proposed decision to correct clerical errors and omissions and to clarify portions of the discussion through minor, textual revisions but otherwise, have not revised the proposed decision. We have disregarded comments that merely reargue positions advanced through testimony and in the briefs.
