The PHC in this matter was held on October 11, 2002, and NRDC timely filed its NOI on October 28, 2002. In its NOI, NRDC addressed its anticipated scope of participation, estimated cost of participation, customer status and significant financial hardship. A finding of significant financial hardship shall create a rebuttable presumption of eligibility for compensation in other Commission proceedings commencing within one year of the date of that finding.2 NRDC filed a supplemental NOI on May 13, 2004, to update its anticipated scope and cost of participation. NRDC timely filed its request for request for compensation within 60 days of D.04-12-016.
NRDC has previously been found eligible for intervenor compensation in D.04-08-042 (August 19, 2004) for its contributions to Decision (D.) 04-01-050, D.03-12-062, D.03-06-071, D.03-06-067 and D.02-10-062 (the "Procurement Decisions"). NRDC received a finding of financial hardship and was found eligible for intervenor compensation pursuant to an ALJ ruling issued May 14, 2003.
