VI. California Environmental Quality Act (CEQA)

CEQA requires the Commission as the lead agency to assess the potential environmental impact of a project so that adverse effects are avoided, alternatives are investigated, and environmental quality is restored or enhanced to the fullest extent possible. Tex-Link represents that it will not construct any facilities other than equipment to be installed in existing buildings or structures for the purpose of providing telecommunication services. Based on this representation, it can be seen with certainty that granting A.05-04-010 will not have an adverse effect on the environment. Tex-Link must file for additional authority, and submit to any required CEQA review, before it constructs facilities other than equipment installed in existing buildings or structures.
