VI. Comments on Proposed Decision

The proposed decision of the ALJ in this matter was mailed to the parties in accordance with Section 311(d) of the Public Utilities Code and Rule 77.1 of the Rules of Practice and Procedure. The parties have stipulated to reduce the comment period to seven calendar days from date of mailing of the proposed decision for opening comments and three calendar days thereafter for reply comments. On September 17, 2002, ORA advised us that it would not be filing either opening or reply comments. On September 18, 2003, Kerman filed opening comments requesting that Finding of Fact 5 be revised to reflect the overcollection was in 2002, not Test Year 2003, and representing that ORA concurred with this request. That correction is appropriate and has been made.
