12. Water Quality Compliance

In Schedule 2 of Exhibit 31, SCWC has presented its water quality compliance record from March 1998 to December 2002, updating the data presented to the Commission in the Water Quality OII. SCWC seeks a finding from this Commission that it is in compliance with present drinking water standards and water quality regulations.

In its report for the update period, SCWC has provided instances of noncompliance with drinking water standards, instances the drinking water standards were exceeded, number of citations from the DHS, corrective measures taken to comply with regulations and corrective measures related to 10-day letters of compliance. However, whether this information is complete and accurate and whether it warrants a finding that SCWC remains in compliance with applicable drinking water standards and water quality regulations needs to be verified, preferably by the DHS. No such verification has been established in this proceeding. For this reason, we cannot make the finding as requested by SCWC.
