D.05-05-008 determined that this proceeding should be set for hearing and accordingly, as required by Rule 6.5 of the Commission's Rules of Practice and Procedure (Rules), changed the preliminary determination that no hearing would be required. However, hearings were cancelled after the parties filed their Settlement Agreement.
