Order Instituting Rulemaking on the establishment of a public purpose program surcharge pursuant to Assembly Bill 1002. |
Summary: On February 3, 2004, Judy Peck, Regulatory Relations Manager for Southern California Gas Company and San Diego Gas & Electric Company (Sempra Utilities), met with Trina Horner, advisor to Cmmr. Lynch, in San Francisco. Peck explained that Sempra Utilities (Sempra) have over 20 years of experience administering gas R&D programs and the should maintain their role as program managers and administrators. Peck noted that utility administration ensures that the Commission retains complete jurisdiction over these programs. Peck asked the Commission's support in maintaining utility administration of these important programs.

Southern California Gas Company (U 904-G), in compliance with Resolution G-3334 for a System of Firm, Tradable Receipt Point Capacity Rights and related provisions. |
Summary: On January 30, 2004, Lad Lorenz, Vice President, Regulatory Affairs, Southern California Gas Company (SoCalGas), met with Roosevelt Grant, advisor to Cmmr. Peevey, in San Francisco. Also present was Leslie Katz, Regional Vice President, Regulatory Affairs; and David Gilmore, Regulatory Attorney, Steve Watson, Capacity Products Staff Manager, and Rodger Schwecke, Pipeline Products Manager, for SoCalGas attended the meeting by telephone. Katz commended ALJ DeUlloa and Cmmr. Brown for their efforts on such an expedited and efficient hearing process as well as the proposed decision (PD). Katz stated that the PD accurately reflected the scope and evidence of that proceeding; however, the Comprehensive Settlement Agreement has lost its critical mass of customer and supplier support and also does not adequately meet the needs resulting from the changed market conditions. Katz recommended to reject the PD and suggested that instead of implementing an incomplete solution to market needs, the Commission should address firm access rights through the Gas Market Order Instituting Rulemaking that was recently instituted.

Southern California Edison Company, for authority to recover capital additions to its fossil generating facilities made between January 1, 1997 and March 31, 1998 or the date of divestiture for those generating facilities divested by July 8, 1998 and related substantive and procedural relief. |
Summary: On February 2, 2004, Robert Finkelstein, attorney for The Utility Reform Network (TURN), met with Aaron Johnson, advisor to Cmmr. Lynch, in San Francisco. Finkelstein urged adoption of TURN's recommendations on payback periods and heat rate improvements as a straightforward approach to addressing the revised proposed decision's (PD) shortcomings regarding findings of reasonableness and consistency with the `necessary to maintain' standard of Section 367. Finkelstein stated that the revised PD would have the Commission commit legal error by allowing recovery of costs it never finds reasonable (and, in light of the record evidence, cannot find reasonable), particularly recovery of costs that the utility conceded were not eligible for recovery. Rather than fix the obvious errors through the rehearing process, Finkelstein urged that the Commission address these issues now.

Lodi Gas Storage, LLC, for a certificate of public convenience and necessity for construction and operation of gas storage facilities. |
Summary: On February 3, 2004, Daniel Fessler, representing Lodi Gas Storage, L.L.C. (LGS) telephoned Cmmr. Brown. Also participating in the call was Belinda Gatti, advisor to Cmmr. Brown, and James Boothe, representing LGS. Fessler discussed the generic problem that LGS confronts at the Commission: as a relatively small utility, its requests for resolution and applications are assigned a lower priority in the Commission's workload; at the same time, the Commission maintains its formal regulatory process with respect to all requests from LGS, however minor. Fessler emphasized that, although the LGS matters are of minor moments at the Commission, they involve significant dollars for a business the size of LGS. Fessler noted that the regulatory time delay and associated cost make it very difficult to justify further investment of gas storage infrastructure in California. Fessler stated that LGS would like to see expeditious action on this matter.

Southwest Gas Corporation (U 905-G), for Authority to Change Natural Gas Rates in San Bernardino, El Dorado and Nevada Counties, California. |
Summary: On February 3, 2004, Robert M. Pocta, Program Manager, Office of Ratepayer Advocates (ORA), met with Cmmr. Kennedy in San Francisco. Also present were Brian Prusnek, advisor to Cmmr. Kennedy, and Danilo Sanchez, Program and Project Supervisor, for ORA. Written material (attached to the notice) was used. Pocta stated that the revenue requirement increases in the alternate of Cmmr. Lynch provides a fair General Rate Case increase to Southwest Gas Corporation (Southwest). Pocta stated that there were three differences between the alternate and the proposed decision (PD) and that the three changes were appropriate and reasonable. Pocta noted that the alternate uses 2002 recorded plant additions rather than the higher Southwest forecast used by the PD to develop the 2003 test year estimates. Pocta noted that the alternate uses an accurate figure for capital expenditures which is fair to both ratepayers and shareholders. Pocta explained that the second difference between the alternate and PD involves the pipeline replacement program. Sanchez noted that there were no specific or unusual safety concerns or excessive leak problems that would require an accelerated program.

Summary: AUGMENTATION REQUIRED. On February 3, 2004, Norman A. Pedersen, counsel for the Southern California Generation Coalition (SCGC), met with Roosevelt Grant, advisor to Pres. Peevey. Also present were Marcel Hawiger for The Utility Reform Network and Matthew Brady for the Department of General Services. Pedersen informed the Commission about SCGC's objections to the Comprehensive Settlement Agreement (CSA). Pedersen said that the CSA was an industry initiative, which, in the four years since the CSA was filed has lost industry support, and that circumstances had changed since the CSA was filed. Pedersen referred to R04-01-025 (OIR) and stated that the OIR could moot many of the assumptions that underlie the CSA. Pedersen also observed that in the OIR the Commission would be examining whether utilities should be put at risk, which would challenge a CSA assumption that Southern California Gas Company should be put 100 percent at risk for backbone revenues.

Summary: LATE FILED. On February 2, 2004, Bruce Foster, Vice President of Regulatory Operations of Southern California Edison Company (SCE), met with Roosevelt Grant, advisor to Pres. Peevey, in San Francisco. Brian Prusnek, advisor to Cmmr. Kennedy, participated in the meeting by telephone. Also present were John Hughes, Manager, Regulatory Relations, and Dr. Michael Alexander, Manager of Energy Regulation, for SCE. Dr. Alexander expressed SCE's concern that, although Resolution 3334 called for the implementation of D01-12-018 with modification for changed circumstances, the hearing in the proceeding was limited to litigation of Southern California Gas Company's compliance case. Dr. Alexander stated that while the Comprehensive Settlement Agreement (CSA) was filed by parties, it is now four years old, and that, as a result of changed circumstances, support had significantly eroded. Alexander expressed concern that under the proposed decision (PD) SCE would have virtually no rights in the first two rounds of receipt point allocation, and that therefore the cost to SCE's customers would be significant. Foster added that the use of historical receipt points served to the detriment of SCE's ratepayers and that, at a minimum, some recognition of forecasted delivery must be considered. Hughes added that the PD ignored all of SCE's recommended changes. Dr. Alexander explained out that it was no longer possible to implement D01-12-018.

Order Instituting Rulemaking to Establish Policies and Cost Recovery Mechanisms for Generation Procurement and Renewable Resource Development. |
Summary: LATE FILED. On January 4, 2004, Alvin S. Pak, Director of Regulatory Policy & Analysis, Sempra Energy Global Enterprises, representing Sempra Energy Resources (SER), met with David Gamson, advisor to Cmmr. Brown, and Roosevelt Grant III, advisor to Pres. Peevey, in two separate meetings in San Francisco. In the meeting with Roosevelt Grant III also participated Julie Fitch, advisor to Pres. Peevey. Also present were William R. Engelbrecht, Vice President of Energy Supply for SER, and Dale Kelly-Cochrane, Vice President of Budget & Planning for Sempra Energy LNG Corp. (LNG). SER's representatives noted that the issue of affiliate transactions continues to be addressed in this proceeding in disregard of prior procedural instructions and despite the lack of an evidentiary record. Pak pointed out that the testimony of the parties never mentioned or recommended the adoption of an outright ban on affiliate transactions. Engelbrecht stated that SER had just brought over 2350 megawatts of high-efficiency generation into the southwestern market and that precluding their participation in a future competitive solicitation conducted by affiliate San Diego Gas & Electric Company (SDG&E) would reduce the liquidity in the SDG&E market to the detriment of ratepayers. Kelly-Cochrane stated that the recently issued decision was unclear as to whether the affiliate ban covered gas-related and potentially LNG-related transactions and noted that this could affect the utilities' access to the benefits of LNG supplies. SER representatives concluded by indicating that Sempra companies would be seeking to reverse or stay the ban pending a full evidentiary exploration of the implications and adverse consequences of the affiliate ban as part of a duly convened evidentiary hearing.
