Unless otherwise directed, all courier-delivered documents submitted for filing as part of the formal record in a proceeding should be hand-carried directly to the Commission's Docket Office, Room 2001, 505 Van Ness Avenue in San Francisco; Suite 500, 320 West 4th Street in Los Angeles; or Room 4006, 1350 Front Street in San Diego. All documents sent through the mail for formal filing should be addressed ONLY to the Commission's Docket Office, Room 2001, 505 Van Ness Avenue, San Francisco, CA 94102.
To purchase Commission documents, there is a charge of 20 cents a printed page (postage prepaid) with a minimum purchase of $2.00.
The auditorium, hearing rooms and training room at the headquarters of the California Public Utilities Commission, located at 505 Van Ness Avenue, San Francisco, are available for rent. Further information about requirements and fees can be obtained by contacting Colette Kondo at (415) 703-1401.
In compliance with Public Utilities Code Section 311.5, parties who wish to subscribe to receive draft agenda items may do so by writing to the Public Utilities Commission; Attention: Poly Arca, Room 1003, 505 Van Ness Avenue, San Francisco, CA 94102, or by calling (415) 703-1798. The cost for a one-year subscription to the entire public agenda package (which excludes Executive Session materials) is $1,000. You may also order a partial agenda package (energy agenda items only or telecommunication agenda items only) at the cost of $500 per year. The package you receive via mail will include only those agenda items available at the time of the agenda distribution date, which is usually 10 to 12 days prior to the Commission meeting. If agenda items (including revisions) are not ready on the distribution date, they will be made available at no charge in the lobby outside the Commission Auditorium at 9:00 a.m. on the morning of the Commission meeting, but not earlier.
In addition, the Commission will make draft agenda items available for viewing and photocopying (at 20 cents per page) at the Commission's Central Files Office (Room 2002), 505 Van Ness Avenue, San Francisco, and in the Los Angeles, San Diego, and Sacramento field offices. Since the agenda package will be mailed to these locations, it will be available at these locations a day or two after the distribution date. These locations will not receive agenda items that are not ready on the distribution date.
If an agenda item is held over to a subsequent Commission meeting, that agenda item and any revisions to that agenda item that were available on the morning of the initial Commission meeting (as well as any further available revisions) will be mailed in the Escutia package for the subsequent Commission meeting; the item and its revisions will also be available for viewing and photocopying in the Commission's Central Files Office and field offices as set forth above.
Intervenors who have a financial hardship determination pending or granted shall be eligible to receive draft agenda item packets at no charge.
The cost to receive the agenda only, without copies of draft agenda items, remains at $75 per year.
Parties who wish to subscribe to the Daily Calendar and/or the Agenda may do so by writing to the Public Utilities Commission; Attention: Poly Arca, Room 1003, 505 Van Ness Avenue, San Francisco, CA 94102, or by calling (415) 703-1798. Rulemaking 02-06-001 on policies and practices for advanced metering, demand response, and dynamic pricing will hold a Working Group 2 (large customers, demand greater than 200kW) meeting to review compliance tariff filings. The meeting will be held pending the approval of the final decision of ALJ Carew, or the alternate decision (Comm. Lynch) on June 5.

Per D03-03-007, Energy Division is conducting a workshop to examine issues related to the SMJUs' accounting and reporting methods of the California Alternate Rate for Energy (CARE) and Low-Income Energy Efficiency (LIEE) programs. The workshop is designed to develop greater consistency in standard reporting requirements for the SMJUs' annual CARE reports required under Decision 05-07-019.

Summary: On June 4, 2003, Michael Day of Goodin, MacBride, Squeri, Ritchie & Day, counsel for Wild Goose Storage Inc. (Wild Goose), met with Belinda Gatti, advisor to Cmmr. Brown, in San Francisco. Day discussed the proposed decision (PD) and indicated that a review of the related legal precedents provided no clear explanation or justification for the imposition of a penalty substantially larger than those imposed on previous nunc pro tunc approvals under Section 854. Day noted that Wild Goose has, as the PD admits, sought to fully and timely comply with reporting and disclosure requirements, and further, that Wild Goose had previously filed a Section 854 application when the shares of Wild Goose were directly transferred to another entity, thus disproving any intent to conceal such transactions from the Commission. Day also noted that the PD's reliance on a very minor change in the composition of the Board of Directors was an insufficient basis for the conclusion that a change in control of the utility had occurred. | |

Summary: On June 3, 2003, John Ballas, Director of Public Works for the City of Industry (City), met with Manuel Ramirez, advisor to Cmmr. Wood, and David Gamson, advisor to Cmmr. Brown, in two separate meetings in San Francisco. Also present were Richard Mrlik, consultant, and Jose E. Guzman, Jr., attorney, for the City. At the meeting with David Gamson also present was Kevin Coughlan, advisor to Pres. Peevey. Written material (attached to the notice) was used. The parties discussed cost responsibility surcharges for municipal departing load (MDL). Guzman stated that the City supports Cmmr. Brown's alternate and opposes the proposed decision (PD) of ALJ Pulsifer. Ballas stated that the City has invested over $4 million and countless staff time in planning and formation of its municipal electric utility. Mrlik stated that if the PD was adopted, the City's substantial investment in its electric service would be severely impaired. The City's representatives discussed the concept of `service territory' as it related to the MDL issue. Guzman stated that an IOU's service territory is established by franchises but that such franchises are almost always non-exclusive franchises. Guzman noted that in the case of the City, the franchise it granted to Southern California Edison Company is a non-exclusive franchise. | |

Summary: On June 3, 2003, Marcel Hawiger, attorney for The Utility Reform Network (TURN), met with Aaron Johnson, advisor to Cmmr. Lynch, David Gamson, advisor to Cmmr. Brown, and Julie Fitch, advisor to Pres. Peevey, in three separate meetings in San Francisco. Also present was Sara Steck Myers, attorney for TURN. The meeting with David Gamson was followed by an email (attached to the notice). Hawiger and Myers indicated TURN's support for the alternate of Cmmr. Lynch addressing demand response goals and adopting tariffs and programs for large customers. Hawiger and Myers stated that TURN's concerns with the draft decision, especially with respect to issues of parity between large and small customers with respect to advanced meters or demand response tariffs, had been recognized and addressed in the alternate. In particular, Hawiger and Myers stated that the alternate, as opposed to the draft decision, better reflects the actual record on and likely results from demand response programs. | |
