The Western Energy Market Access Forum, a one-day program hosted by the CPUC, and sponsored by National Association of Regulatory Utility Commissioners (NARUC) and the Department of Energy, will focus on utility Women/Minority Business Entrepreneur (WMBE) Development programs; regulatory models that increase marketplace participation and reduce barriers to market entry; and initiatives and opportunities in energy and telecommunications. The forum will also explore the portability and application of programs like the California Regulatory model in other states. The forum aims to encourage utility participation in WMBE market access programs, which includes gas, electricity, water and telecommunication markets and the procurement of all goods and services.
Speakers and participants include California PUC Commissioners, California utility CEO's and managers, and WMBE companies.
An agenda will be posted at
www.cpuc.ca.gov. For further information please contact Art Jimenez, WMDVBE program manager at (415) 703-4112.

Commission Staff along with the California Energy Commission and the California Power Authority will host a workshop to define the potential for energy efficiency programs in California to maximize energy savings over the next five to ten years. The intent of the workshop is to get input from parties interested in energy efficiency, including research and development companies, energy service companies, utilities, equipment vendors, program designers, building science researchers, appliance manufacturers and building energy managers to help identify new measures or energy management systems that could provide California customers with significant energy savings over the next five to ten years. The July 3rd Assigned Commissioner's Ruling in R01-08-028 identified this as one of several topics to be resolved. No teleconference access has been established for this meeting. The location is wheelchair accessible. Contact: Lainie Motamedi at (415) 703-1764 or lrm@cpuc.ca.gov <mailto:lrm@cpuc.ca.gov>.

Summary: On September 29, 2003, Elaine M. Duncan, Vice-President General Counsel, Verizon California Inc. (Verizon), met with Tim Sullivan, advisor to Cmmr. Kennedy, in San Francisco. Also present were William Petersen, Associate General Counsel, and Kurt Rasmussen, Senior Staff Consultant-Regulatory, for Verizon. Parties discussed the Federal Communications Commission's (FCC) Triennial Review nine-month proceeding. Duncan stated that the incumbent local exchange carriers (ILECs) did not have access to all information required in order to conduct the impairment analysis required by the FCC, and that the Commission has a crucial fact-gathering role to fulfill in order to obtain complete information from as many carriers as possible. Referring to a process in which the markets were defined first and the triggers applied, Petersen stated that the triggers provide an objective test and allow for he possibility of curtailed proceedings. Petersen stated that the Commission should require ILECs, in their initial filings, to identify the network elements they intend to challenge, the relevant markets in which they intend to make these challenges, and the triggers they intend to satisfy.

Summary: On September 30, 2003, Truman Burns, Public Utilities Regulatory Analyst in the Office of Ratepayer Advocates (ORA), met with Pres. Peevey and Mike Campbell, advisor to Cmmr. Lynch, in two separate meetings in San Francisco. At the meeting with Pres. Peevey also present was Peter Arth, advisor to Pres. Peevey, and with Mike Campbell - Steven Weissman, advisor to Cmmr. Wood, and David Gamson, advisor to Cmmr. Brown. Representatives from the Diablo Canyon Independent Safety Committee (DCISC), the San Luis Obispo Mothers for Peace (SLOM4P), and Pacific Gas and Electric Company (PG&E) participated in both meetings. Burns spoke about ORA's support for the continuation of the DCISC and about three of the four requests made by the SLOM4P: a fourth member on the DCISC from the public, removing PG&E from the selection process of committee membership, and expanded outreach by the DCISC.

Pacific Gas and Electric Company, in the 1999 annual transition cost proceeding. |
Summary: On September 29, 2003, Sabrina Chaw, Senior Regulatory Representative, Regulatory Relations, Pacific Gas & Electric Company (PG&E), met with Julie Fitch, advisor to Pres. Peevey, in San Francisco. Also present was Joe O'Flanagan, Director, Vice President and Controller, PG&E. Chaw stated that Cmmr. Lynch's alternate is unacceptable to PG&E as the alternate would require PG&E to place the Hunters Point Power Plant (HPPP) decommissioning costs in the Transition Cost Balancing Account, while ALJ's proposed decision would require that these costs be incorporated into PG&E's general rate case (GRC). Chaw stated that including the costs in the GRC obviates the need for a one-way balancing account for these costs. O'Flanagan stated that the alternate is also inconsistent with the GRC settlement that the Office of Ratepayer Advocates, The Utility Reform Network, and others had agreed upon. O'Flanagan also refuted the City and County of San Francisco's arguments that PG&E would profit from insurance proceeds if the HPPP decommissioning costs exceeded the original estimate. O'Flanagan stated further that if ratepayers funded 100% of the decommissioning cost they would be entitled to 100% of the gain and that this would be accomplished by crediting the proceeds to the decommissioning reserve.

Pacific Gas and Electric Company, in its 2002 Nuclear Decommissioning Cost Triennial Proceeding. |
Summary: On September 29, 2003, John Clarke, Manager, Regulatory Relations, Pacific Gas & Electric Company (PG&E), met with Julie Fitch, advisor to Cmmr. Peevey, and David Gamson, advisor to Cmmr. Brown, in two separate meetings in San Francisco. Also present was Valerie Winn, Manager, Energy Revenue Requirement, for PG&E. Clarke stated that PG&E supports the proposed decision of ALJ O'Donnell because it represents a fair compromise of positions taken by parties. Clarke stated further that PG&E does not support the alternate of Cmmr. Lynch because the forecast assumptions it uses for return on investments, contingency factors, and low level radioactive waste disposal (LLRWD) are unreasonable. Winn stated that the LLRWD cost adopted in the alternate is based on a proprietary contract between two other parties and that it does not reflect anticipated costs when disposal facilities become available. Further, Winn stated that the combined contingency factor adopted by the alternate is unreasonably low.

Summary: On October 1, 2003, Robert Finkelstein, attorney for The Utility Reform Network (TURN), met with Cmmr. Brown in San Francisco. Also present were Robert Wullenjohn, advisor to Cmmr. Brown, and Darwin Farrar and Dale Piiru, for the Office of Ratepayer Advocates. Finkelstein noted that even with the recently announced revisions to the Kennedy/Peevey alternate (KPA), the Lynch/Wood alternate (LWA) was the far better choice of the two. Finkelstein noted that while the revisions to the KPA slightly improved the tone of that alternate, they were more cosmetic than substantive. Finkelstein expressed concern that even with the language confirming that service quality would be addressed in Phase 3B, parties would seek to severely limit such Phase 3B issues. Finkelstein asserted that the LWA has the advantage of emphasizing a comparison of performance under NRF to date versus performance under NRF in the future, rather than a flawed theoretical discussion of the incentives under NRF as compared to cost-of-service ratemaking that appears in the KPA. Finkelstein noted that this is more consistent with the goal of Phase 3B as to service quality issues; how to improve upon the track record achieved to date under NRF. Finkelstein also noted that the revisions to the KPA now add two sections and that the LWA is more reasonable outcome by virtue of its omission of the material in these two sections of the KPA and the elimination of any future factual or legal dispute over the assertions made in that material.

Summary: On September 30, 2003, John Leslie, attorney for Coral Power, L.L.C. (Coral), met with David Gamson, advisor to Cmmr. Brown, in San Francisco. Also present were Mike Campbell, advisor to Cmmr. Lynch, Julie Fitch, advisor to Pres. Peevey, Manuel Ramirez, advisor to Cmmr. Wood, Mona Petrochko, Director of Government Affairs, Constellation New Energy, Greg Bass, Direct Access Operations Manager, Sempra Energy Solutions, and Marcie Milner, Director of Regulatory Affairs, Coral. Parties discussed the draft decision (DD) of ALJ Wong on AB 117 ESP registration requirements. Leslie expressed concern about the process used in developing the DD. Leslie stated that the DD was circulated without an opportunity for comment and that AB 117 was not self-implementing. Leslie stated that the Commission should have issued an Order Instituting Rulemaking in which the Commission solicited comments from interested parties. Leslie expressed concern regarding four of the ESP registration requirements recommended in the DD: fingerprinting, disclosure of officers' felony convictions, reporting of the background of key personnel; and the security deposit.

Point Arena Water Works, Inc., for an order authorizing a rate increase in rates subject to refund producing additional annual revenues of $70,137 or 56.9% for the test year 2002. |
Summary: On September 30, 2003, Leslie Dahlhoff, mayor of the City of Point Arena, met with Belinda Gatti, advisor to Cmmr. Brown, in San Francisco. Dahlhoff stated that the proposed decision would exclude the extraordinary revenues amounting to $362,000 from the scope of the ongoing ratecase, and that alternate would include the refund revenue in the scope. Dahlhoff expressed support for the alternate. Dahlhoff described the impact of the water company's legal expenses that will be passed on to the ratepayers, and noted the lack of the Office of Ratepayer Advocates' assistance or other oversight in Class C and D ratecases and the fact that no audit was done for 1994, 1995 and 1998, the years in which the extraordinary revenue was received. Dahlhoff also discussed the excessive expenses and revenue requirements of Point Arena Water Works, Inc.

Point Arena Water Works, Inc., for an order authorizing a rate increase in rates subject to refund producing additional annual revenues of $70,137 or 56.9% for the test year 2002. |
Summary: On October 1, 2003, Leslie Dahlhoff, mayor of the City of Point Arena, met with Cmmr. Wood and Tim Sullivan, advisor to Cmmr. Kennedy, in two separate meetings in San Francisco. At the meeting with Cmmr. Wood also present was Jonathan Lakritz, advisor to Cmmr. Wood. Written materials (attached to the notice) were used. Dahlhoff stated that the proposed decision would exclude the extraordinary revenues amounting to $362,000 from the scope of the ongoing ratecase, and that alternate would allow its inclusion. Dahlhoff noted the impact of the water company's legal expenses that will be passed on to the ratepayers and described how it is a major deterrent to ratepayer litigation of rates in the case of small water companies. Dahlhoff also noted a lack of a clear appeal process for ratepayers in informal proceedings and review of comparative data showing excessive staff approved expenses in many expense categories. Dahlhoff pointed out at the unapproved extension of the service area and possible co-mingling of ratebase with CIAC and privately owned improvements; possible violation of the CPN for Whiskey Shoals service area subjecting significant economic impact on the ratepayers in the Point Arena service area.
