Order instituting investigation on the Commission's own motion to assess and revise the New Regulatory Framework for Pacific Bell and Verizon California Incorporated. |
Summary: On October 10, 2003, Yvette Hogue, Executive Director-Regulatory Proceedings, Pacific Bell Telephone Company (SBC California), had a telephone conversation with Robert Wullenjohn, advisor to Cmmr. Brown. Hogue stated that the alternate of Cmmrs. Lynch and Wood should be modified with regard to issues referred to Phase 3B of the New Regulatory Framework proceeding. Hogue argued that service quality issues that impact all California consumers should be addressed in R02-12-004. Hogue noted that there is no evidence in the record to justify making a new issue in phase 3B that would address the transfer of functions to unregulated utilities.

Order Instituting Rulemaking to Establish Policies and Cost Recovery Mechanisms for Generation Procurement and Renewable Resource Development. |
Summary: On October 10, 2003, Nancy Rader, Executive Director of California Wind Energy Association (CalWEA), met with Julie Fitch, advisor to Pres. Peevey, at the office of enXco in Tracy, California. Also present were Roosevelt Grant, advisor to Pres. Peevey, Aaron Johnson and Mike Campbell, advisors to Cmmr. Lynch, David Gamson, advisor to Cmmr. Brown, Brian Prusnek, advisor to Cmmr. Kennedy, Steve Weissman and Manuel Ramirez, advisors to Cmmr. Wood, Dan Adler, John Galloway, and Don Smith, for the Commission, Lisa Cottle and Joseph Karp of White & Case LLP, attorney for CalWEA, and George Hardie of G3 Energy. Hardie discussed the amount of wind generation in the Altamont pass and G3 Energy's plans to repower existing wind generators. Rader discussed the difficulties associated with obtaining federal production tax credits and in negotiating with the utilities. Karp stated that the utilities have not necessarily accepted that they need to purchase, at avoided cost prices, power provided by qualifying facilities in excess of amounts already being generated under existing contracts, but the Commission has a proceeding to address this issue.

Summary: LATE FILED. On October 1, 2003, Darwin E. Farrar, attorney for the Office of Ratepayer Advocates (ORA), met with Cmmr. Brown in San Francisco. Also present were Robert Wullenjohn, advisor to Cmmr. Brown, Dale Piiru, Senior Analyst, ORA, and Robert Finkelstein, attorney for The Utility Reform Network. Farrar expressed ORA's support for the Lynch/Wood alternate (LWA), and noted that even with the recently announced revisions to the Kennedy/Peevey alternate (KPA), the LWA was the better of the two. Farrar noted that while the revisions in the KPA slightly improved the tone of that alternate, they were more cosmetic than substantive. Piiru also expressed concern that even with the language confirming that service quality would be addressed in Phase 3B, parties would seek to severely limit such Phase 3B issues. Farrar concluded by noting that the LWA is a more reasonable outcome by virtue of its elimination of any future factual or legal disputes over the assertions made in that material.

Pacific Gas and Electric Company (U 39-E), for Review of and Authorization for Recovery of Costs relating to its Low Emission Vehicle (LEV) Program for 2002 through 2005. |
Summary: On October 14, 2003, Sabrina Chaw, Regulatory Representative, Regulatory Relations, Pacific Gas and Electric Company (PG&E), had a telephone conversation with David Gamson, advisor to Cmmr. Brown, and also met with Julie Fitch, advisor to Cmmr. Peevey, in San Francisco. At the meeting with Julie Fitch also present were Roosevelt Grant, advisor to Cmmr. Peevey, Belinda Gatti, advisor to Cmmr. Brown, and Norm Stone, Manager, Customer Energy Management, and Gail Slocum, attorney, for PG&E. Chaw stated that Cmmr. Kennedy's alternate decision (KAD) is a well-reasoned decision which is superior to Cmmr. Lynch's alternate decision (LAD) because KAD recognizes the importance of the Low-Emission Vehicle (LEV) industry, while the LAD deceptively harms the LEV industry with its proposed actions. Chaw noted a few recommended changes to the KAD. Slocum indicated that it was more administratively prudent and supportive of the still transitioning LEV industry to change the KAD to reflect multi-year funding approval, with a possible evergreen provision. Stone emphasized that even CARB and CEC pointed out that a self-sustaining LEV market is not likely before 2010.
