The purpose of this public-input workshop is to present updated costs and bill savings of the LIEE program for PY2001, PY2002, and PY2003, as ordered by ordering paragraph 4 of Decision (D) 01-12-020 in Rulemaking 01-08-027. This report will be filed as part of the Annual Earnings Assessment Proceeding (A03-05-002) and will explain variations across utilities as well as discuss how the variables and calculations used are consistent with other measurement studies used in the Annual Earnings Assessment Proceeding. Equipoise Consulting will present the draft results and will incorporate any public comments into the Final Report due May 1, 2004.

BACKGROUND
Public Utilities Code Section 761.3 establishes a process for the adoption and implementation of maintenance and operations standards for many of the electric power plants that serve California. First, the California Electricity Generation Facilities Standards Committee (Committee) adopts and revises the standards. Then, the California Public Utilities Commission (Commission) implements and enforces the standards adopted by the Committee. Various generating facilities including many nuclear, publicly owned, and qualifying facilities have been exempted from maintenance and operations standards. (See Public Utilities Code Section 761.3(d), (h) for further details.)

APRIL 7TH MEETING
At its meeting on April 7th, the Committee will consider a final draft of (and possibly adopt) Logbook Standards for Hydroelectric Generating Facilities, and hear a progress report on the development of Operations Standards. (A complete and more detailed agenda appears on the third page of this notice.)

Summary: On March 24, 2004, Erik Jacobson, Chief of Regulatory Relations of Pacific Gas and Electric Company (PG&E), met with Julie Fitch, advisor to Cmmr. Peevey, in San Francisco. Also present were Mark Pocta, Manager, Energy Cost of Service, for the Office of Ratepayer Advocates, Patrick Golden, Attorney, Jan Berman, Director of Rates & Tariffs, for PG&E, and Robert Finkelstein, Executive Director, The Utility Reform Network. Golden described the issues covered by the GRC distribution and generation settlements. Golden stated that the Distributing Settlement resolves a number of customer service, accounting, record keeping and other issues raised by the settling parties. Berman explained the magnitude of revenue requirement reductions made in the settlements compared to PG&E's request. Berman stated that overall PG&E reduced its requested revenue requirement by approximately $67 million in the Generation Settlement, and an additional $305 million in the Distribution Settlement. Berman explained that the Commission decision regarding the pension contribution issue could affect these numbers. | |

Hanschen stated that Folsom was quite concerned with the cloud that had been cast over Folsom's water rights as a result of the Commission's actions. Hanschen pointed out that both Cmmr. Brown and Cmmr. Lynch indicated that Folsom's rights under the transaction were protected; however, the decision does not reflect this assumption with respect to Folsom's future rights. Rudolph discussed why Folsom is a good faith purchaser for value and entitled to the conclusive presumption set forth in Section 851.
