Brown. Emery Borsodi, General Manager - Regulatory Proceedings, SBC, also participated. SBC representatives stated that SBC consistently followed GAAP and that there is no basis for the Commission to rule that SBC should have created a regulatory asset for the Local Number Portability (LNP) and the Local Competition implementation costs. SBC asserted that any LNP corrections made by the Commission should be limited to the issue of jurisdictional assignment.

Summary: On July 21, 2004, Erik Jacobson, Chief, Regulatory Relations of Pacific Gas and Electric Company (PG&E), met with Brian Prusnek, advisor to Cmmr. Kennedy, in San Francisco. Also present was Bill Blastic, Director, Electric Control Center Operations, PG&E. Written material (attached to the notice) was used. Jacobson stated that PG&E recommends that the Commission adopt the reliability incentive mechanism agreed to by PG&E and CUE. Jacobson explained that in the event that the Commission does not provide PG&E with the incremental revenues necessary to achieve the reliability targets in PG&E/CUE joint agreement, PG&E recommends that the benchmarks be based on PG&E's average historical performance and that the deadband be large enough to account for performance variations. Blastic explained that reliability performance statistics are not comparable across utilities.

Order Instituting Rulemaking regarding the implementation of the suspension of direct access pursuant to Assembly Bill 1X and Decision 01-09-060. |
Summary: On July 22, 2004, Eric Eisenman, Chief, Regulatory Relations, Pacific Gas and Electric Company (PG&E), met with David Gamson, advisor to Cmmr. Brown, in San Francisco. Also present was David Rubin, Director, Service Analysis, PG&E. Eisenman asserted that the cost responsibility surcharge should be applied to new load located within PG&E's service territory but taking service from publicly owned utilities. Rubin stated that the Department of Water Resources (DWR) testified in this proceeding that when DWR procured power on behalf of all customers in PG&E's service territory, that it did not adjust PG&E's forecast for publicly-owned utilities reaching into PG&E's territory. Rubin explained that this means power procurement costs were incurred on behalf of new load locating within PG&E's service territory by DWR, and that exempting new load from its fair share would burden all other customers with the associated costs. Rubin noted that PG&E has an obligation to serve every new customer locating within its service territory and that some publicly owned utilities behave like a commercial entity and `cherry-pick' individual customers.

Pacific Gas and Electric Company, for a Certificate of Public Convenience and Necessity Authorizing the Construction of the Jefferson-Martin 230 kV Transmission Project. |
Summary: On July 23, 2004, Philip Batchelder, Executive Director of San Bruno Mountain Watch, met with Cmmr. Lynch in San Francisco. Also present were Darwin Farrar, advisor to Cmmr. Lynch, Anita Garcia, legal intern, and Jake Sigg, Conservation Chair of the California Native Plant Society's Yerba Buena Chapter, Doug Allshouse, President of the Friends of San Bruno Mountain, and Francisco Da Costa, Executive Director of Environmental Justice Advocacy. Batchelder, Sigg and Allshouse discussed the San Bruno Mountain (Mountain) Conservation Plan as it relates to the `Mountain Alternative' (Alternative) of the Project. Allshouse, Sigg and Batchelder described the Alternative's likely impacts to rare species' habitat and the mitigations for the damage. Allshouse, Sigg, and Batchelder described the poor state of the PG&E transmission lines on the Mountain, including the corridor to which the new 230kV line would be collocated under the Alternative. However, Allshouse, Sigg, Batchelder, and Da Costa acknowledged the substantial public health concerns over electromagnetic fields and all agreed to the benefits of a further study of the Alterative. Da Costa asserted that such a study should include a thorough examination of the proposal's potential impacts to archeological and sacred sites. Batchelder suggested that the study would benefit from a review of PG&E past mitigation efforts for damaging projects on the Mountain. Batchelder encouraged an examination of the feasibility of routing the transmission line through a directional bore at the base of the Mountain.
