The ALJ Ruling issued on June 2, 2004 directed the Working Group 2 moderator to "schedule workshops for summer 2004 whose purpose is to promote discussion and further fleshing out of the various utility proposals described in the April 1 [2004] reports." At the first workshop, background presentations were given by the utilities on their proposals, and the schedule and agenda for the upcoming workshops were discussed. Other parties had the opportunity to provide comment and input on the utility program proposals at the second workshop. California Public Utilities Commission |
BACKGROUND
Public Utilities Code Section 761.3 establishes a process for the adoption and implementation of maintenance and operations standards for many of the electric power plants that serve California. First, the California Electricity Generation Facilities Standards Committee (Committee) adopts and revises the standards. Then, the California Public Utilities Commission (Commission) implements and enforces the standards adopted by the Committee. Various generating facilities including many nuclear, publicly owned, and qualifying facilities have been exempted from maintenance and operations standards. (See Public Utilities Code Section 761.3 (d), (h) for further details.)
For more information on the Commission's proceeding to implement these standards, please see the Commission website:
http://www.cpuc.ca.gov/proceedings/R0211039_doc.htm.
SEPTEMBER 20-21 WORKSHOPS
At the workshops on September 20 - 21, Committee Staff will consider feedback regarding draft Operations Standards listed on the Committee website under "Items of Interest":
http://www.cpuc.ca.gov/static/cegfsc/index.htm. You can also reach this website by clicking on the Committee link at the lower left of the Commission's webpage at
http://www.cpuc.ca.gov.
Before the workshops, Committee Staff solicits comments and reply comments from interested parties and stakeholders which will be used to shape workshop agenda. Opening comments are due on September 10, 2004 and reply comments on September 15, 2004. Focus of the workshops will be the policy and technical aspects of the standards. They will also primarily focus on the performance standards with secondary focus on implementation guidelines.
The policy of the Committee and the Commission is to schedule hearings, meetings, workshops and similar events in locations accessible to people with disabilities. To verify that a particular location is accessible, please call: Calendar Clerk
(415) 703-1203. If specialized accommodations for the disabled are needed (e.g., sign language interpreter), those requesting the accommodations must call the Commission's Public Advisor at (415) 703-2074, TTY 1-866-836-7825 or (415) 703-5282 at least three working days in advance of the event.

Draft Resolution approving confidentiality provisions for exempt wholesale generators who provide information to the Commission pursuant to Commission authority that is independent of implementation and enforcement duties related to Public Utilities Code 761.3.
A draft resolution (L-312) by the Legal Division which would replace the confidentiality provisions in L-293, with the confidentiality provisions in General Order 167, § 15.4 with respect to exempt wholesale generators, is scheduled for consideration on the September 23, 2004 Commission meeting agenda. The Commission may vote on this resolution at that time, or it may postpone a vote. The Commission may adopt all or part of L-312, amend or modify it, or set it aside and prepare a different resolution.
On August 19, 2004, the draft resolution was circulated to all known interested parties and exempt wholesale generators, including the Service Lists for Proceedings I00-08-002, and R02-11-039, pursuant to Public Utilities Code Section 311(g) and Rules 77.7 and 81 of the Commission's Rules of Practice and Procedure. Interested parties may review the draft resolution and service list at the "Currently Open for Comment" section of the Commission's Internet site at cpuc.ca.gov.
The Commission will consider the draft resolution at its September 23, 2004 meeting. Interested parties may file comments on the draft resolution, and may file replies to comments. An original and 2 copies of comments must be filed with the Legal Division by September 13, 2004, at the address set forth below. Reply comments must be filed by September 20, 2004. Commenters must also serve comments, and reply comments, on the service list, and send copies of comments and reply comments by electronic mail to the e-mail address below. Comments shall focus on factual, legal or technical error in the draft resolution, and reply comments shall be limited to identifying misrepresentations of law and fact contained in the comments of other parties. (Rule 77.7.) Parties may view comments at the Commission's San Francisco Office.

Order Instituting Rulemaking to promote policy and program coordination and integration in electric utility resource planning. |
Summary: On August 23, 2004, Lisa Cottle of White & Case LLP, attorneys for the California Cogeneration Council (CCC), spoke on the telephone with Julie Fitch, advisor to Cmmr. Peevey. Cottle communicated the CCC's interest in determining the scope of the qualifying facility issues and explained that, if the Commission defers a decision on long-term QF policy issues, all three utilities must be required to reserve a place for QF capacity in their resource plans. | |
