Order Instituting Rulemaking to Examine the Commission's Future Energy Efficiency Policies, Administration and Programs.
Commissioner Kennedy has scheduled this Oral Argument to discuss the current version of the Draft Decision document on the issue of Energy Efficiency Administration. Please note that this Draft Decision has not been officially released per PU Code 311(g) and has been shared for DISCUSSION PURPOSES ONLY. The Oral Argument will provide the opportunity for all Commissioners' offices to hear comments and views on this issue. Discussion of legal issues and policy issues raised by this draft will be discussed. Notification of Capacity Markets Conference:
The California Public Utilities Commission (Commission), the California Independent System Operator Corporation (CAISO), and the California Electricity Oversight Board (CEOB) will co-sponsor an educational conference on capacity markets.
The purpose of the conference is to provide a foundational level of understanding about how these markets have worked in the East. The objective is to examine the degree to which capacity markets have successfully worked to foster resource adequacy and a stabile investment environment. The intention is to draw on practical experiences from around the country to facilitate a constructive dialogue about the options that California has available to it in assuring investment in new and existing resources, including how capacity markets can complement the CAISO's market design and the Commission's resource adequacy policy.

The ALJ Ruling issued on June 2, 2004 directed the Working Group 2 moderator to "schedule workshops for summer 2004 whose purpose is to promote discussion and further fleshing out of the various utility proposals described in the April 1 [2004] reports." At the first workshop, background presentations were given by the utilities on their proposals, and the schedule and agenda for the upcoming workshops were discussed. Other parties had the opportunity to provide comment and input on the utility program proposals at the second workshop. At the third workshop, the utilities presented their revised proposals. The Water Division is hosting these continuation workshops to solicit public input on the need for modification of the Rate Case Plan for Class A Water Utility General Rate Applications (Commission Decision 90-08-045).
The purpose of the workshop is two-fold:
To identify the least controversial issues in the Draft Proposed Rate Case Plan for Class A Water Utility General Rate Applications prepared by the Water Division and;
To discuss the necessary components of an interim rate case plan schedule for year 2004.

BACKGROUND
Public Utilities Code Section 761.3 establishes a process for the adoption and implementation of maintenance and operations standards for many of the electric power plants that serve California. First, the California Electricity Generation Facilities Standards Committee (Committee) adopts and revises the standards. Then, the California Public Utilities Commission (Commission) implements and enforces the standards adopted by the Committee. Various generating facilities including many nuclear, publicly owned, and qualifying facilities have been exempted from maintenance and operations standards. (See Public Utilities Code Section 761.3 (d), (h) for further details.)

SEPTEMBER 20-21 WORKSHOPS
At the workshops on September 20 - 21, Committee Staff will consider feedback regarding draft Operations Standards listed on the Committee website under "Items of Interest":

Before the workshops, Committee Staff solicits comments and reply comments from interested parties and stakeholders which will be used to shape workshop agenda. Opening comments are due on September 10, 2004 and reply comments on September 15, 2004. Focus of the workshops will be the policy and technical aspects of the standards. They will also primarily focus on the performance standards with secondary focus on implementation guidelines.

Draft Resolution approving confidentiality provisions for exempt wholesale generators who provide information to the Commission pursuant to Commission authority that is independent of implementation and enforcement duties related to Public Utilities Code 761.3.
A draft resolution (L-312) by the Legal Division which would replace the confidentiality provisions in L-293, with the confidentiality provisions in General Order 167, § 15.4 with respect to exempt wholesale generators, is scheduled for consideration on the September 23, 2004 Commission meeting agenda. The Commission may vote on this resolution at that time, or it may postpone a vote. The Commission may adopt all or part of L-312, amend or modify it, or set it aside and prepare a different resolution.
On August 19, 2004, the draft resolution was circulated to all known interested parties and exempt wholesale generators, including the Service Lists for Proceedings I00-08-002, and R02-11-039, pursuant to Public Utilities Code Section 311(g) and Rules 77.7 and 81 of the Commission's Rules of Practice and Procedure. Interested parties may review the draft resolution and service list at the "Currently Open for Comment" section of the Commission's Internet site at cpuc.ca.gov.
The Commission will consider the draft resolution at its September 23, 2004 meeting. Interested parties may file comments on the draft resolution, and may file replies to comments. An original and 2 copies of comments must be filed with the Legal Division by September 13, 2004, at the address set forth below. Reply comments must be filed by September 20, 2004. Commenters must also serve comments, and reply comments, on the service list, and send copies of comments and reply comments by electronic mail to the e-mail address below. Comments shall focus on factual, legal or technical error in the draft resolution, and reply comments shall be limited to identifying misrepresentations of law and fact contained in the comments of other parties. (Rule 77.7.) Parties may view comments at the Commission's San Francisco Office.

Summary: LATE FILED. On August 23, 2004, Mike Preston, Vice Mayor of the City of San Marcos (City), met with Cmmr. Wood in San Diego. Also present were Steven Weissman, advisor to Cmmr. Wood, and Rick Gittings, the City Manager. Vice Mayor Preston discussed the impacts associated with Community Choice Aggregation relating to not only the exit fee issue, as well as to direct access issues, but also the concept of investor owned utilities (IOUs) adding an additional `exit fee' in order to fully plan their resource allocation mix in the future if communities began buying energy for customers within their community, which are also customers of the IOU. The City representatives also discussed a Joint Powers Agreement between the City of Victorville and the City of San Marcos and explained how that might assist in generating new energy within the State of California, particularly energy that may be found and declared to be `renewable resources/green energy'. The City representatives also noted the importance of the process and establishing the rules for AB 117 Community Choice Aggregation. | |

Also present were Julie Fitch, advisor to Cmmr. Peevey, and Alan Fohrer, Chief Executive Officer, and Robert Foster, President, of SCE. The SCE representatives indicated that replacement of the San Onofre Nuclear Generating Station Unit Nos. 2 and 3 (SONGS 2 & 3) steam generators was going to be difficult because of the need to cut a hole in the containment buildings and detension tendons in those buildings. SCE representatives stated that SCE needed to get into the queue for replacement steam generator (RSG) fabrication within the next 30-60 days so that SONGS 2 RSGs could be available in spring 2009. SCE representatives also stated that SCE will shortly file a motion requesting an interim decision on cost-effectiveness and ratemaking issues on its SONGS 2 & 3 Steam Generator Replacement Application in April 2005 and urged the Commission to grant SCE's request. | |
