The Water Division is hosting this continuation workshop to solicit public input on the need for modification of the Rate Case Plan for Class A Water Utility General Rate Applications (Commission Decision 90-08-045).
The purpose of the workshop is two fold:
To identify the least controversial issues in the Draft Proposed Rate Case Plan for Class A Water Utility General Rate Applications prepared by the Water Division and;
To discuss the necessary components of an interim rate case plan schedule for year 2004.

Decision 04-09-022 states that the CPUC should coordinate with the California Energy Commission to examine gas quality issues in a technical workshop. This workshop will address the natural gas quality specification issues that were raised in Order Instituting Rulemaking (R.) 04-01-025, and certain issues presented in the California Energy Commission's 2003 Integrated Energy Policy Report, docket number 04-IEP-1. This workshop is to be conducted jointly under the auspices of California Public Utilities Commission and California Energy Commission, with the collaboration of Air Resources Board and California Department of Conservation - Division of Oil, Gas, and Geothermal Resources.
Audio from this workshop will be broadcast over the Internet and comments and presentations will be posted on both CPUC's and CEC's web sites:
www.cpuc.ca.gov and
www.energy.ca.gov/webcast/.
Participants desiring to make a presentations are requested to contact the CPUC and Energy Commission, as indicated below, by November 29, 2004, and provide copies of their presentations by December 6, 2004, so they can be loaded on the CPUC's and Energy Commission's websites for remote viewing. Participants are encouraged to provide their presentations in a PowerPoint or equivalent format to: David Effross, at

Rulemaking to Set Hourly Rates for Purposes of Calculating Intervenor Compensation Awards, Pursuant to Public Utilities Code Section 1801 and Following, for Work Performed in Calendar Year 2005. The workshop in the above-entitled matter will be held before Administrative Law Judge Steve Kotz.
The Telecommunications Division has prepared Resolution T-16900, tentatively scheduled to be included on the

NOTICE OF DRAFT RESOLUTIONS
(Pursuant to PU Code § 311(g))
Draft Resolution Authorizing a One-Time Deviation from the Process for Appointing Members to the
Diablo Canyon Independent Safety Committee Established by Commission Decisions D88-12-083 and D04-05-055
Draft Resolution L-315 of the Legal Division approves Legal Division's request for a one-time deviation from the process established by Commission Decisions D88-12-083 and D04-05-055, pursuant to which membership vacancies on the Diablo Canyon Independent Safety Committee are filled.
Draft Resolution L-315 will be on the agenda at the Commission's December 16, 2004 meeting. The Commission may then vote on the resolution or it may postpone a vote until later. Only when the Commission acts does the Resolution become binding on the parties.
On November 15, 2004, draft Resolution L-315 was circulated to the parties to Commission Docket Nos. A02-11-017 and I03-01-012 (the Pacific Gas and Electric Company's Test Year 2003 General Rate Case). Interested parties may submit comments on the draft Resolution. In accordance with
Rule 77.7(c) of the Commission's Rules of Practice and Procedure, comments concerning the Draft Resolution shall be due on December 6, 2004, with reply comments due on December 11, 2004.
Interested parties may review the draft resolution and service list at the "Currently Open for Comment" section of the Commission's internet site at cpuc.ca.gov.
If any party to Docket Nos. A02-11-017 and I03-01-012 believes that an evidentiary hearing is required in order for the Commission to take the action it proposes to take in this Draft Resolution, in its comments to be filed by December 6, 2004, it must: (i) request an evidentiary hearing; (ii) identify the material disputed issue or issues of fact that require such an evidentiary hearing; (iii) identify the nature of the testimony it would introduce at an evidentiary hearing; and (iv) explain why such a hearing is required, with citation to any relevant legal authority. Any possible right that any party to Docket Nos. A02-11-017 and I03-01-012 may have to an evidentiary hearing on the matter that is the subject of this Draft Resolution will be waived if the party does not properly request such a hearing in its comments to be filed by December 6, 2004, which comments must include the above-required information.

Those submitting comments must serve a copy of their comments on 1) the entire service list attached to this notice, 2) all Commissioners, and 3) the Commission's General Counsel, on the same date that the comments are submitted to the Legal Division.
Comments due on December 6, 2004 shall be limited to five pages in length, plus an appendix listing any recommended changes to the draft Resolution, including recommended changes to the proposed findings and ordering paragraphs.
Comments shall focus on factual, legal or technical errors in the proposed draft Resolution. Comments that merely reargue positions taken in the proceedings referenced above will be accorded no weight and are not to be submitted.
Replies to comments on the draft resolution due on December 11, 2004 shall be limited to identifying misrepresentations of law or fact contained in the comments of other parties. Replies shall not exceed five pages in length, and shall be filed and served as set forth above for comments.

Robinson emphasized that it is practical to adopt the batch hot cut prices approved for Verizon by the New York Public Service Commission as interim prices. Robinson also urged that the Commission should incorporate additional guidance from that order. | |

Summary: On November 8, 2004, Frank Schultz, Manager of Management Analysis of the San Francisco Bay Area Rapid Transit District (BART), met with Peter Arth, advisor to Cmmr. Peevey, in San Francisco. Also present were Julie Fitch, advisor to Cmmr. Peevey, and Ed O'Neill, outside counsel to BART. Written materials (attached to the notice) were used. BART discussed the draft decision (DD) of ALJ Kenney. O'Neill stated that BART only recently became aware that the DD does not recognize the special terms and conditions under which federal preference power has been historically delivered to BART or recent legislation, SB 1201, intended to permit BART to continue receiving deliveries of power in the future from local publicly owned suppliers on the same terms and conditions. O'Neill stated that, if not revised, the DD could conflict with the intent of the legislature in enacting SB 1201 and have a significant adverse financial effect on BART. To remedy this unintended result, Schultz and O'Neill urged the Commission to modify the DD. | |||
