The workshop in the above-entitled matter will be held before Administrative Law Judge Mark S. Wetzell or advisory staff.
January 28, 2005 |
California Public Utilities Commission |
At the Pre-Hearing Conference held on January 14, 2005, the assigned Administrative Law Judge, ALJ McKenzie, directed that a workshop be held on January 28 to explore and resolve issues raised in protests to the utilities' applications. The issues include, but are not limited to: (1) the extent to which reliability may be impaired as a result of increasing load on utility systems in the summer of 2005, and possible means of mitigating those concerns; (2) whether the utilities' proposed incentives contribute to margin, or instead negatively impact other ratepayers; and (3) whether the increased capital costs and operation and maintenance costs associated with the proposals for additional line extension incentives will, in the future, have to be borne by other ratepayers. At the workshop, participants will have the opportunity to identify positions, respond to opposing proposals, and propose remedies or approaches to develop workable incentives with positive gains for the other ratepayers. To submit additional agenda items, other than those mentioned at the January 14 PHC or for further information, contact Kathryn Auriemma of the CPUC's Energy Division by email at kdw@cpuc.ca.gov or by phone at (415) 703-2072.

In Decision (D.) 03-07-028, as modified by D03-08-076, D04-11-014, and D04-12-059, the Commission imposed a Cost Responsibility Surcharge (CRS) on Municipal Departing Load (MDL) within the service territories of Pacific Gas and Electric Company, Southern California Edison Company, and San Diego Gas & Electric Company, but deferred issues relating to the billing and collection of the MDL CRS for further consideration. On December 23, 2004, the assigned Administrative Law Judge issued a ruling ordering a technical workshop to be held on January 31, 2005 for purposes of identifying positions and seeking consensus on process and procedures for billing and collection of MDL CRS. At the workshop, participants will have the opportunity to identify positions, respond to opposing proposals, and propose remedies or approaches to satisfy the billing and collection requirements set forth in the above-referenced decisions. Climate Change and the IOUs |
CPUC Auditorium |
The CPUC will hold a public meeting, chaired by President Peevey, on the issue of climate change. The purpose of this meeting will be to move "beyond energy procurement" and to begin to identify best practices for all CPUC regulated companies (electric, natural gas, telecommunications, water, and transportation). Opportunities to reduce greenhouse gas emissions related to business operations include fleet vehicle efficiency, building efficiencies, and overall reduction of energy consumption. The U.S. is the world's largest greenhouse gas emitter and is responsible for approximately 25% of the world's emissions. California policymakers and businesses have the opportunity to proactively address this issue, to demonstrate effective leadership, and to make a significant contribution to emissions reduction. Invited presenters include representatives from the academic, research, business, insurance, shareholder activist, and state government organizations. Business and industry leaders will also be asked to respond to a recent CPUC summary paper on the subject. In addition, the IOUs should be prepared to present their current and anticipated efforts to address climate change. Information about the meeting, including a link to the discussion paper and the agenda are posted at www.cpuc.ca.gov/static/industry/electric/climate+change/index.htm#meeting and can also be found on the CPUC's homepage at www.cpuc.ca.gov. All utilities are asked to RSVP to confirm their attendance and to discuss their presentations. To RSVP, and for further information, please contact Lainie Motamedi, CPUC Division of Strategic Planning, at (415) 703-1764 or lrm@cpuc.ca.gov.

Summary: On January 20, 2005, Michelle Robinson, Vice President- Regulatory, Verizon California Inc. (Verizon), met with Karen Miller, advisor to Cmmr. Grueneich, in San Francisco. Also present was Larry Chaset, advisor to Cmmr. Grueneich. A declaration (copy attached) of Virginia P. Ruesterholz, filed in the United States District Court of Appeals for the District of Columbia Circuit (USTA v. FCC, No. 00-1012, et al.) was used. Robinson discussed generally the issues that resulted in Verizon's filing the petition to modify with an emphasis on the revised draft decision (RDD) which adopts a significantly reduced common cost mark-up. Robinson explained the possibility of material errors given the RDD's arbitrary use of a common cost factor that is inconsistent with the interim UNE prices. Robinson also shared that common cost issues are currently being debated in Verizon's permanent UNE proceeding, and that any concerns about the Ninth Circuit Court's decision regarding SBC's common cost mark-up should be addressed there. Robinson also discussed the implications of the Federal Communications Commission's press release and anticipated UNE-P price increases. | |
