The Energy Resources Conservation and Development Commission (CEC) and the PUC will jointly discuss: the continuing implementation of the 2003 Energy Action Plan and the transition to a new 2005 Energy Action Plan, a report on the outlook for the summer 2005, and a joint proposal of the CEC, the CPUC, and the California Independent System Operator (CAISO) to establish a single electricity planning and procurement process for California through integration of all resources.
No decisions will be made at this public meeting. A quorum of Commissioners from the California Public Utilities Commission may be present. Any person who wishes to address the members may do so by signing up at the start of the meeting. Public comments will be limited given the time constraints of the members; individual speakers should expect to have no more than 3 minutes.

The Assigned Commissioner's Ruling issued on February 3, 2005 scheduled a series of workshops in Phase 2 of the Community Choice Aggregation proceeding. The fourth workshop in this series will address the issue of CCA Implementation Plans. The purpose of these workshops is to promote understanding and narrow the issues that must be litigated. The Commission will conduct the workshops with the objective of finding common ground among the parties in as many issue areas as possible. The issues to be covered in this series of workshops are: Open Season Procedures and Policies; CRS Vintaging; Tariffs; CCA Implementation Plans; and Credits and Liability for In-kind Power.

I.04-06-008 - Investigation on the Commission's Own Motion Into the Fitness of the Officers, Directors, Owners and Affiliates of Clear World Communications Corporation, U-6039, Including Individual Officers, Directors and Shareholders James, Michael, and Joseph Mancuso, and Into the Conduct of Other Utilities, Entities, or Individuals (including Christopher Mancuso) Who or That May Have Facilitated the Mancusos' Apparent Unlicensed Sale of Telecommunications Services, Presiding Officer's Decision of ALJ Walker We conclude that two predecessor companies of Clear World Communications Corporation (Clear World) operated as unauthorized resellers of long distance service in California between the years 1997 and 1999 and were not "agents" of other licensed resellers, and we conclude that the assets of one of these companies were transferred to Clear World without authorization. Based on penalties assessed in similar cases in the past, we impose a fine of $100,000. As to Clear World itself, we conclude that while incidents of fraudulent sales of long distance service by some of its telemarketers may have occurred, the evidence is insufficient to show systemic violations by Clear World or its principals. However, because the record demonstrates inconsistencies in regulatory compliance by this company, we impose additional reporting requirements on Clear World to ensure its continued compliance with requirements of the Public Utilities Code. This proceeding is closed. |

Worden stated that the main reason for increased depreciation rates is plant removal costs or negative salvage for the 2006 GRC. Worden and Hughes also addressed Transmission and Distribution related plant additions and operations and maintenance expenses and pointed out that SCE's infrastructure replacement program will continue through 2008 with almost $10 billion of capital being added. Worden also pointed out that SCE is proposing a one-time PBOP refund of approximately $140 million in 2006. Worden and Hughes also discussed the jointly managed SCE/ORA total compensation study. Hughes stated that the study showed Edison to be 1.6 percent above market or well within the plus or minus 5 percent range that the Commission has found to be reasonable. | |

Frank, Special Counsel for the City of South Pasadena (City), met with Ross LaJeunesse, advisor to Cmmr. Kennedy, in San Francisco; and on February 22, 2005, participated in an all-party telephonic conference with ALJ Simon. At the meeting of February 10, 2005, also present were Martin Mattes, counsel to the Metropolitan Construction Authority, and David Margrave, member of PAMRC. In the February 22, 2005, telephonic conference also participated Michael Montgomery for the City, David Margrave and Ernest Arnold for PAMRC, Joe Guzman for the Construction Authority, and Martin Mattes, Augustin Zuniga, and Vijay Khawani for the MTA. Frank discussed whether the reference in the proposed decision (PD) to AREMA standards should be modified to permit testing with the shrouds attached and whether both anechoic chamber and field testing should be done. Frank requested a conference call or permission to make a filing to explain the City's position regarding the perceived ambiguity in the revisions to the PD. During the February 22, 2005 telephonic conference, the City sated that the February 10, 2005 version of the PD needed clarification on the application of AREMA standards. The City also took the position that testing should include the noise shrouds. With respect to the motion to strike, the City's representatives stated that the two relevant letters do not comply with the Commission's ex parte rules. With respect to the possible application of federal noise standards, the City's representatives stated that the Commission's broad jurisdiction would permit the Commission to consider or apply the same noise level standards to Phase I of the Gold Line as are being applied to the Eastside Extension and Phase II of the Gold Line. The City also indicated that waiting for a final opinion until March 17, 2005, would be an undesirable delay. | |
