The Assigned Commissioner's Ruling issued on February 3, 2005 scheduled a series of workshops in Phase 2 of the Community Choice Aggregation proceeding. The fifth workshop in this series will address the issue of Credits and Liability for In-Kind Power. The purpose of these workshops is to promote understanding and narrow the issues that must be litigated. The Commission will conduct the workshops with the objective of finding common ground among the parties in as many issue areas as possible. The issues to be covered in this series of workshops are: Open Season Procedures and Policies; CRS Vintaging; Tariffs; CCA Implementation Plans; and Credits and Liability for In-kind Power.

Low Income Oversight Board (LIOB) |
The Low Income Oversight Board (LIOB) will meet to discuss, review and decide on: (1) approval of previous Board Meeting minutes, (2) the use of Energy Star Appliances, (3) New Measures Assessment (4) LIOB sub-committee report on the replacement of leaky water heaters, (5) the Low Income Standardization Project, (6) Settlement on Flu CO Levels Post Testing, (7) comments & reply comments on the proposed changes to the Policy & Procedures and Installations Standards Manuals (including parties' allegation that the Standardization Team should be subject to the Bagley-Keene Open Meeting Act, (8) status of Low Income projects, (9) status of low-income program deployment, and (10) the Board's Financial Report. The LIOB will also review recent Legislative bills, CPUC rulings, discuss pending CPUC orders and potential LIOB comments on any draft orders, new business, strategic planning for upcoming issues, and agenda planning for future meetings.

Summary: On March 10, 2005, Jennifer Chamberlin, Market Manager, Regulatory Affairs, Strategic Energy, L.L.C., representing the Alliance for Retail Energy Markets (AReM), met with Julie Fitch, advisor to Cmmr. Peevey, in San Francisco. Also present were David Gamson, advisor to Cmmr. Brown, and Bill Chen, Director of Governmental Affairs, Constellation NewEnergy, Inc., and Sue Mara, Principal, RTO Advisors, APS Energy Services, Inc., on behalf of AReM. The AReM representatives discussed the draft decision (DD) of ALJ Wetzell modifying the Order Instituting Rulemaking to name electric service providers (ESPs) and community choice aggregators (CCAs) as respondents. AReM representatives stated that it would be filing comments recommending that the Commission reject the DD and administer resource adequacy requirements for ESPs through the existing ESP registration/licensing framework. AReM representatives stated that, in the event the Commission determines that ESPs and CCAs should be named as respondents, AReM recommends that the Commission open a separate, narrowly defined proceeding for that purpose. AReM representatives also stressed the need for protection of confidential data submitted by ESPs. AReM representatives discussed the Draft Second Interim Opinion Regarding Resource Adequacy, stating that an all-hours resource adequacy requirement is not needed. AReM also stated that it should be made clear that LSEs are not required to procure resources beyond what is needed to serve their loads plus 15 percent to 17 percent reserves. | |
