The Full Panel Hearing (En Banc) in the above-entitled matter will be held before a quorum of the Commission with Assigned Commissioner Susan P. Kennedy and Administrative Law Judge Jacqueline A. Reed presiding.

Blaising indicated that the DD claims that there are policy justifications for treating MDL differently than CGDL in stand-alone situations, however, there are no policy issues implicated by the stand-alone issue. Rather, Blaising observed, Public Utilities Code Section 369 provides a strict, definitional basis for determining stand-alone situations. Blaising also noted that the Commission must treat MDL and CGDL similarly. Graham argued that an appropriate reserve margin of capacity allows the market flexibility to move purchases between receipt points, creating more gas-on-gas competition. In conclusion, Graham stated that northern California has sufficient backbone transmission and storage infrastructure, as compared to the proposed backbone capacity guideline, through 2016. Halverson stated that a full and timely recovery of investments in backbone capacity is necessary. | |
