The Information and Management Services Division has prepared Draft Resolution M-4185 for the November 18, 2005 Commission meeting. The fee levels set by Draft Resolution M-4185 for passenger vehicle operators, vessel operators, commercial air operators and pipeline corporations are unchanged from the fee levels set for fiscal year 2004-05. The fee level set for the railroad corporations reflect a $1,113,000 increase from the level set for fiscal year 2004-05 due to an increase in rail safety staffing and funding for a rail safety working group. A draft resolution (TL-19066) of the Consumer Protection and Safety Division that (1) extends for one year the authority granted to vessel common carriers (VCCs) by Resolutions TL-19042 and TL-19051 to adjust their passenger fares and freight rates without specific Commission authorization and (2) revises the authorized "zone of reasonableness" from 15% to 20% above current base fares and rates, will be on December 1, 2005, Commission meeting agenda. The Commission may vote on this resolution at that time, or it may postpone a vote until later. When the Commission votes on Resolution TL-19066, it may adopt all or part of it as written, amend or modify it, or set it aside and prepare a different resolution.
Resolution TL-19042, issued June 9, 2004, authorized VCCs to assess a surcharge of up to 15% to offset significant increases in fuel prices. The authority was extended until December 2, 2005, by Resolution TL-19051.

An original and two copies of comments must be received by the Consumer Protection and Safety Division by November 21, 2005. Comments shall be limited to five pages in length and shall focus on factual, legal, or technical errors in the proposed resolution.
The Telecommunications Division has prepared Resolution T-16963 for the December 1, 2005, Commission Agenda. This resolution proposes the approval of the California High Cost Fund-A (CHCF-A) surcharge rate from 0.15% to 0.21%, effective January 1, 2006 and thereafter. There will be an all-party meeting with Commissioner Dian M. Grueneich and Kelly A. Hymes, telecommunications advisor to Commissioner Grueneich, to discuss the SBC/AT&T and Verizon/MCI merger proceedings. All parties are invited to meet with Commissioner Grueneich to discuss the following issues: I.) California Attorney General's Opinions regarding both merger cases; II.) Absence of formal evidentiary hearings for the Verizon/MCI merger case; III.) Pros and Cons of including IP network interconnection conditions in both merger cases; IV.) Comparison of conditions between the Verizon merger proposed decision and Kennedy/Peevey alternate decision for the SBC merger; and V.) Other Issues of Concern.
All participants must provide Commissioner Grueneich's office with the names of individuals who will be participating, their affiliation, and telephone/fax number to be reached in the event of changes to this meeting.
