Energy Division Advice Letter Disposition Change
As of June 25, 2007, the Energy Division of the CPUC will send utilities notices of the disposition of Advice Letters by electronic means rather than by hard copy in the regular mail, and will no longer be returning hard copies of approved tariff pages to the utilities. San Diego Office Closes
The Commission's San Diego Office will be closing permanently effective June 22, 2007 and will no longer be able to accept hand delivered filings. Documents may be filed electronically on the Commission's website at http://www.cpuc.ca.gov/static/efiling.htm. In the event that you wish to file your document in hard copy, rather than electronically, documents should be taken directly to the Commission's lobby or mailed to the Commission's Docket Office in San Francisco, 505 Van Ness Avenue, San Francisco, California 94102. Only hand-delivered documents will be accepted by the Los Angeles office, 320 West 4th Street, Suite 500, Los Angeles.
Starting May 24, 2004, the Central Files Office will be open for business from 8 a.m. to 12 noon only.
To purchase Commission documents, there is a charge of 20 cents a printed page (postage prepaid) with a minimum purchase of $2.00.
The auditorium, hearing rooms and training room at the headquarters of the California Public Utilities Commission, located at 505 Van Ness Avenue, San Francisco, are available for rent. Further information about requirements and fees can be obtained by contacting Colette Kondo at (415) 703-1401.

We will ask for the Local Jurisdiction's preference regarding which area code option should be implemented, and we will additionally, discuss the status of numbering in the 818 area code geographic area. The ALJ Division has prepared Resolution ROSB-001 for the October 4, 2007 Commission Agenda. This resolution adopts a Railroad Carrier Citation Program for Enforcing Compliance with General Orders and Other Requirements, Including Procedures for Appeal of Citations Issued to Railroad Carriers.
This Resolution approves a citation program under the administration of the Director of the Consumer Protection and Safety Division for enforcing compliance with certain General Orders and other requirements for railroad carriers operating in California.

NOTICE OF RESOLUTION AUTHORIZING PUBLIC DISCLOSURE OF INVESTIGATION RECORDS
Draft Resolution L-349 authorizes disclosure of records related to the California Public Utilities Commission ("Commission") Consumer Protection and Safety Division's investigation of the May 16, 2007, electrical incident that occurred at 20225 Case Street, Corona, California, involving the injury of Roberto Angulo.
Draft Resolution L-349 will be on the agenda at the Commission's October 4, 2007, meeting. The Commission may then vote on the resolution or it may postpone a vote until later. The Commission may adopt all or part of L-349, amend or modify it, or set it aside and prepare a different resolution.
On September 4, 2007, the draft resolution was circulated to the Resolution L-349 service list, pursuant to California Public Utilities Code § 311(g) and Rule 14.2(c)(2) of the Commission's Rules of Practice and Procedure. Interested parties may review the draft resolution and service list at the "Currently Open for Comment" section of the Commission's Internet site at www.cpuc.ca.gov.
Interested parties may file comments on the draft resolution, and may file replies to comments (Rule 14.5). The original and two copies must be filed with the Legal Division by September 24, 2007, at the address set forth below. Reply comments must be filed by September 29, 2007. Commenters must also serve comments and reply comments on the service list. Commenters may send copies of comments and reply comments by electronic mail to the email address below. NOTICE OF RESOLUTION AUTHORIZING PUBLIC DISCLOSURE OF INVESTIGATION RECORDS

The ALJ Division has prepared Resolution ALJ-209 for the November 1, 2007 Commission Agenda. This resolution Affirming Citation FC-104 issued to Lincoln Limousine Services, Inc.
This Resolution resolves the appeal of Field Citation 104 (FC-104), issued to Lincoln Limousine Services Inc. by the Commission's Consumer Protection and Safety Division on May 10, 2007. FC-104 was issued with a fine in the amount of $1,250 for limousine service operations after the expiration of Commission authority and failure by Lincoln Limousine to have its employees covered under workers' compensation insurance requirements, subject to the Department of Motor Vehicles' pull notice program, and enrolled in a mandatory drug testing program.

The ALJ Division has prepared Resolution ALJ-208 for the November 1, 2007 Agenda. In this resolution, the Commission considers the appeal by Peak Communications, Inc. (Respondent) of Third-Party Verification Citation Forfeiture No. 102 issued by the Consumer Protection and Safety Division pursuant to Resolutions UEB-001. The Citation Forfeiture alleges that Respondent failed to comply with Public Utilities Code Section 2889.5.
Based on the evidentiary record, we find that Respondent failed to confirm that the customer wanted to switch carriers. As such, Citation Forfeiture No. 102 is affirmed.

SCE shall refund and forgo all $48 million in PBR customer satisfaction rewards it has claimed. Employees and management manipulated the mechanism for seven years; those seven years of bad data were submitted to the Commission. In regard to the Health and Safety PBR, SCE submitted false and misleading information. It shall refund to ratepayers the $20 million it has collected for 1997-2000, and forgo $15 million in health and safety rewards for 2001-2003. The revenue requirement portion of Results Sharing attributed to PBR data should be refunded because of fraudulent data in regard to OSHA recordables and customer satisfaction, in the amount of $76,663,200. SCE shall pay a fine of $40,000,000 for violations of the Public Utilities Code. | |

Hawiger summarized TURN's positions concerning shareholder incentives and stated that the 'supply-side comparability' model was inconsistent with the reality of utility capital spending and power purchase decisions, as utility capital spending would not be reduced due to energy efficiency since the utilities would likely reduce purchased power if demand was reduced. Hawiger explained TURN's position concerning the financial benefits to the utilities due to alternative uses of freed-up capital when supplyside projects are deferred due to energy efficiency. Summary: On September 26, 2007 Diana Lee of the Division of Ratepayer Advocates (DRA), Legal Division met with ALJ Bemesderfer in San Francisco. Lee explained that DRA supported an approach to PacifiCorp's energy efficiency activities that recognized the scale of PacifiCorp's California activities, but was concerned about the apparent high level of administrative costs proposed in it application and other issues that DRA raised in its protest. Lee pointed out that DRA would be meeting with PacifiCorp next week and would discuss issues related to the application at that time. | |

Summary: On September 28, 2007 Andrew Ulmer, Chief Counsel for the Division of Ratepayer Advocates (DRA) met with Mathew Deal, advisor to Pres. Peevey in San Francisco. Also present was Edward Moldavsky, attorney for DRA. DRA stated the Commission should move forward with a prehearing conference in A.07-07-025. DRA also stated that it intends to ensure that the Commission has all of the necessary information to determine whether or not the underlying transaction in A.07-07-025 meets the standard set forth in California Public Utilities Code § 854, including whether any conditions should attach to the proposed transaction. DRA noted that it has received assurances from the Joint Applicants that the underlying transaction would not result in a nexus between Wild Goose and Lodi, through the Carlyle/Riverstone entities. DRA noted that it is still awaiting data responses from the Joint Applicants to confirm this, as well as clarify other inquiries. | |
