XI. Categorization and Need for Hearings

The June 13, 2006 Assigned Commissioner's Ruling and Scoping Memo confirmed the Commission's preliminary finding in Resolution ALJ 176-3171 dated April 27, 2006 that the category for this proceeding is ratesetting and that hearings are necessary. The settlement in unopposed, and no party has requested hearings. Therefore, we revise our earlier determination and find that hearings are not necessary.
