Rule 1.1: Any person who signs a pleading or brief . . . or transacts business with the Commission . . . agrees to comply with the laws of this State . . . and never to mislead the Commission or its staff by an artifice or false statement of fact or law.

During the period 1997-2003 SCE signed pleadings requesting PBR rewards of $83 million and Results Sharing awards of $32,714,000 based on false and misleading data, which did, in fact, mislead the Commission.

To determine the amount of the fine, we rely on the following criteria adopted by the Commission in D.98-12-075 and followed in New Century Telecom. (D.06-04-048.)
