7. Procedural History

The application was filed on August 27, 2008 and timely protested by the City of Big Bear Lake (City), and DRA filed a motion to dismiss the application. A prehearing Conference and Oral Argument was held on October 30, 2008.¹⁰ Bear Valley amended its application on November 10, 2008 and on December 11, 2008 the City withdrew its protest and substituted a statement of "no position." Similarly, DRA withdrew its motion to dismiss and substituted a response to "not oppose" the amended application. The amended application is, therefore, unopposed.

The record in this proceeding is composed of all documents filed and served in this proceeding and the five exhibits identified within this decision.
