Applicant's name, Anew Telecommunications Corp., could be used in telephone soliciting the same way names like "I Don't Care," were used in the past to slam customers. For example, a telephone solicitor could call someone and say "Would you be interested in taking service from a new telecommunications corporation?" If the customer answers yes, and does not realize that the solicitor was referring to Applicant, he or she has been slammed. When the assigned Administrative Law Judge brought this issue to Applicant's attention, Applicant responded that, since its founder, Jeff Buckingham, has an impeccable compliance record with the Commission, there is no reason to identify it as a potential abuser of consumers. Mr. Buckingham founded Call
America of San Luis Obispo, which was later sold and renamed GST Call America, and is past president of the California Association of Competitive Telecommunications Companies. While we have no reason to believe that Applicant will slam customers, it is reasonable to protect customers from the possibility. Therefore, we will prohibit Applicant from using the name, Anew Telecommunications Corporation, in soliciting customers. Given the fact that Applicant will do business under a dba, such a prohibition should not impose any significant burden.
