2. Background

On August 25, 2010, 5LINX Enterprises, Inc. (5LINX or Applicant) filed an application with the Commission for a certificate of public convenience and necessity (CPCN) to provide resold competitive local exchange and interexchange telephone service in the service territories of Pacific Bell Telephone Company, d/b/a AT&T California (AT&T), Verizon California, Inc. (Verizon), SureWest Telephone (SureWest), and Citizens Telecommunications Company of California, Inc., d/b/a Frontier Communications of California (Frontier) throughout the State of California. The Applicant is a Delaware corporation and a new entrant in the California telecommunications market. Its principal address is 275 Kenneth Drive, Suite 100, Rochester, New York 14623.

On October 26, 2010, the Assigned Administrative Law Judge (ALJ) issued a ruling, requesting further information. On October 29, 2010, Applicant filed its response to the ALJ Ruling.
