VI. Comments on Draft Decision

This is an uncontested matter in which the decision grants the relief requested but subject to the penalty ordered. Accordingly, the public comment provisions of § 311(g)(1) and Rule 77.7(b) of the Commission's Rules of Practice and Procedure apply. Wild Goose filed comments on Commissioner Brown's alternate draft decision on June 10, 2003. The comments argue that the draft decision misinterprets Commission precedent and that, even if it does not, no penalty should be levied. We have reviewed Wild Goose's comments. We conclude that a fair reading of the law supports the draft and have made no substantive changes.
