ORDER DENYING REHEARING
OF DECISION NO. 00-06-067
By this Decision, we deny rehearing of Decision (D.) 00-06-067 (the Decision), which denied a complaint by Eric Diesel ("Applicant" or "Diesel") relating to the construction by Pacific Gas and Electric Company (PG&E) of an electric line extension to his property in a rough, almost inaccessible area of Santa Clara County. The record in this proceeding indicates that requests, disputes and negotiations regarding electric service to this property between Applicant, PG&E and the Commission staff, including former President Fessler, have consumed almost a decade. The record also supports the conclusion made in the Decision that the misrepresentations made by Applicant to PG&E and to our staff resulted in the defrauding of PG&E and its ratepayers. The record is voluminous, and the facts are set out in detail in the Decision. They need not be repeated here for the purposes of disposing of this Application. Moreover, the arguments presented in this Application are virtually identical to those already made in Applicant's appeal of the Presiding Officer's Decision, (POD) and disposed of in the Decision. Generally, they center on the issues of the requirement that Diesel provide an access road as a prerequisite for service, the payment for expenses incurred for tree trimming, and whether Applicant violated the Commission's Rule 1 of our Rules of Practice and Procedure through misrepresentations made regarding proposed construction on the property.
