6. Motion for Protective Order

Mpower filed a motion for a protective order to protect from public disclosure certain portions of the confidential version of its opening brief and its response to SBC California's appeal, which contain material concerning costs and accounting treatment of certain revenues SBC California asserts is proprietary and confidential. We have admitted into evidence under seal the material Mpower relies on in its brief and have granted requests for confidential treatment in this circumstance. We will issue an appropriate protective order.
