IX. Categorization and Need for Hearing

PacifiCorp requested that this matter be categorized as ratesetting. By Resolution ALJ 176-3164, dated December 12, 2005, the Commission preliminarily determined that this was a ratesetting proceeding and that hearings may be necessary. There was no objection to the ratesetting categorization.

Notice of the application appeared in the Commission's Daily Calendar of December 2, 2005. An evidentiary hearing was held on July 26, 27, and 28, 2006 on the issue of whether KWUA irrigation customers should receive a rate credit. This proceeding was submitted upon the receipt of closing briefs on September 18, 2006.
